    Please read!

From reading recent posts, it is clear to me that new posters are not reading through the thread which contains a lot of information which would answer their questions and address many of the concerns being raised.

It has become a little daunting in length but really is a worthwhile read from the beginning!

Was Penfolds also available through others like Tract Management? Are Tract Management still around?
There was a separate thread on TRACT MANAGMENT and I do have information about it.

Have any ex-TRM folks got a copy of the loan agreement paperwork from 08/09?

Raingold have said they can provide the agreement for a £50 fee which I think is a bit of a piss take.

Had a depressing conversation with an accountant today who seems to think its unlikely I can win an appeal. A great way to start the week.

Either way I still will be appealing. I must say this does leave me feeling let down by this country. Retrospective taxation is a joke!

Thats an amazing contrast to the 4 specialists i have spoken to who claim HMRC dont currently have the legislation they need to reclaim tax they think they have lost.

Dont pay them the £50 yet whatever you do

Even with all the paperwork I showed him he missed a few things I had to point out. I think it may have been out o his area of expertise really.

                  Appeal letter responses

Well I was wondering why I hadn't received the generic response to my appeal letter that others have said they received and today I got a self-assessment statement which had added interest to the original amount!

I believe someone said to watch that the left and right arms of HMRC don't always know what eachother are doing, but I am mightily peeved! I sent my appeal letter by Special Delivery and they would have received it 5 days before my appeal deadline date.

I recall that others got a generic response from their appeal letters quickly (i.e. within 5 working days).

I will obviously get int touch with Ms Stopps office tomorrow, but if anyone else has any other advice please let me know. I am getting nervous about the interest being added :fr

Everyone will get a statement I am sure, you just received yours before the letter of reponse to appeal. Presumably you sent your appeal by recorded delivery?

The statement only tells you what you will be able to calculate yourself based on the original assessment letter. If it's making your nervous then that's what they want; in the hope you fold and pay up!

HRMCs EBT scheme enquiry and white collar

Although I had had a letter from HMRC some years ago I was not that concerned as ASMG had submitted their scheme to HMRC and had it approved. <snip>. Post 2008-9 I had various health issues and have now retired. I completed self assessments for subsequent years and for two of them my calculated tax rebate was withheld pendind the investigation. A helpful chap at HMRC offered to investigate the status and the monies were sent to me. This suggested to me that they had agreed the ASMG scheme was legitimate. HM Customs and the Revenue merged some years back. I have worked directly with both of them. I asssure you some do 'knowingly have a sense of humour' but as an organisation tend not to have one opinion. Whether the above is helpful or hopeful perhaps only time will tell. I will appeal and would be happy to consider joint actions with those similarly threatened.
Ive received a similar letter from HRMC. From threads I have read it makes more sense if we pool our resources. If HRMC wins a case against one individual with limited resources and representation in our scheme it means curtains for the rest of us as it sets a precedent. I'm very keen to look into joint action and or investigation. I don't know about you but I was told that they had a high up tax representative from HRMC on their board or advising the board on what was legitimate and that our scheme was.
