HMRC Enquiry letters on Loans from EBT and other schemes
I have just received the letter from HMRC and if I'm honest I have no clue where to start. I am currently living in Australia and I have no books/paperwork from the time I was with Sanzar so am after advise from anyone also living overseas to help. If anyone has a tax lawyer that has had good results in cases like these I would be very interested to hear from you as times is of the essence with just 3 weeks to go before they need a reply from me.
I've also read a few posts here suggesting forming a group to fight HMRC in these cases and just wondered if this has materialised? Sorry so many questions, but worried to be hit with this now.

I too got a HMRC letter completely out of the blue on Saturday for 2008/2009 and having read through every post on this thread, will be creating my appeal / postponement letter in the morning.
Did anyone else use Merchant Group Ltd / ICS Salary Package??? I have printed off their "we are 100% compliant with all uk tax legislation" email in prep for a call to them tomorrow morning!! Surely if these monies are liable, these companies ( and all others ) should be held accountable somehow?
Also, would love to attend the seminar in London - please count me in (admins: can you can grant me PM rights please??)

Out of interest, has anybody here paid the requested tax amount for 08/09? and what was the response from HMRC?
After a not very encouraging response to my appeal and having 3 tax investigation specialists say they are unable to help I feel paying is the only option I have left,the interest added is already a 4 figure amount, my accountant has advised this will just keep increasing along with the cost of paying my accountant to deal with the appeal.
I feel totally mislead and let down by the scheme provider and will be paying off this debt for many years to come.

I see from your ealier post you decided not to lodge your appeal via Cobham Murphy, but via an accountant, based on concerns on timescales. Has your appeal via accountant been fully rejected by HMRC, if so this is the first rejection we've seen on this forum. Could it be that the appeal has been accepted, but the HMRC response is simply saying why they continue to believe the loans are normal income?
I don't know if there is an option to re-submit, have you tried Cobham Murphy? They turned my appeal around in about 7-10 working days, from submission of authority form to receipt by HMRC. HMRC are fully accepting appeals via Cobham. I am not necessarily saying that Cobham would be the right people to progress with for further representation, that remains to be seen if it is needed and what the costs would be.
At this early stage there is no reason to pay up. You just need to get the appeal in and accepted. I believe you can pay up (if you really want to) at any stage even after appeal. HMRC will be more than happy to take your money.
