    Winchester Contractors Trust Help line -Contact Details

    Please can anyone help ,I have e-mailed the [email protected] on several occasions 7 days ago and I am still awaiting a reply, please can anyone advise if this is the norm and does anyone have a Phone Number that I can contact them direct as my account has advised that I need to make contact with THL before I can make any kind of settlement for the DOTAS registration ,

    Hi Mike - we have contacted the trust helpline but I think it's a scam, just like Winchester Contracts were. There appears to be no one at the end of it. We are settling with HMRC. It worries me if we can't contact Winchester Trust though.....I mean, does the loan just sit there if they don't acknowledge that the tax is sorted? We have requested a deed of release (no reply whatsoever). It's disgusting that they can send a letter like this and then completely ignore us when we try to contact them. I have researched the former Company Director of Winchester and he's quite a high standing member of the community (google him). I actually feel like turning up at one of his council meetings to ask him why he has acted in such a disgusting manner. I do wonder if his fellow councillors know his background, as if it were me, I would want to distance myself from him completely in any professional dealings.

      tax avoidance letter

      I too have tried to get in touch with Winchester after receiving their letter about tax avoidance. Before I signed up to them they were adamant that what they were doing was legal and that we would have to pay this so called loan back, but I was still not 100% sure that this was legit so I shortly came out of the scheme as I suspected something was not quite right.

      I've also sent my queries to the email they suggest on the letter but there's been no reply, no telephone contact number, nothing. WHAT IS GOING ON? Can someone explain?

              Me too received a letter saying I NEED to pay back. firstly I feel we are victims of missold information just like PPI but the banks of PPI are compensating their clients. My accountant as advised me this looks like a SCAM and I should not have any contacts with them and they are frightening people to pay to them. Any dealings should be directly with HRMC and I have has received no corresponding from the HRMC so this company is phishing. Deal directly with HRMC if anything

                Fact and opinion

                The following is a mix of fact and opinion and I have indicated which is which.

                This post is intended to de-mystify the situation here to the extent that we are able.

                Facts

                Two wholly owned subsidiaries of Baker Tilly in the Isle of Man, were trustees of certain schemes which used the names: Sanzar, Tudor Pay, Long Acre, Eximius, Darwin, Dynamic Partners, IQ, Garraway and Winchester.

                These schemes ran in various years, not always continuous, between 2004 and the present day.

                In early 2018, the trustees appointed Helpline Services Ltd, trading as Trust Helpline to act as what their latest letter calls "Communications Administrators".

                Helpline Services Ltd data can be found on Companies House and we would recommend that your research begins there.

                Since then there have been a number of communications.

                The latest one (November 2018) discusses APNs, loan charge and settlement. That letter makes certain statements with regards to those issues that we (and perhaps other tax advisers) would take issue with.

                In particular it is claimed that HMRC require a "Deed of Release" for any loan that has been written off. The HMRC officers dealing with our clients, have confirmed in writing, that no such document is required and that they are prepared to accept the word of the client/agent on this issue.

                The latest letter also says that the "loans you received created a genuine liability". The assumption here is that the legal rights and obligations in the loan agreement stand separate from the alleged tax treatment. That is almost certainly true. To resist any claim for repayment will therefore be a legal matter.

                Opinions

                We do not know why Baker Tilly have appointed Helpline Services Ltd nor the extent or limits of their services to the trustee.

                We do know that the appointment was intended and appears to be continuing.

                We are of the opinion that those with a connection to the above schemes can, if they wish, contact the trustee and continue to ask them to deal with matters. The extent to which that trustee may refer you back to Helpline Services is unknown.

                The extent to which the trustee can refuse to deal with you directly and remain compliant with IOM FSA Regulation is unknown.

                The latest communication suggests that a Deed of Release can be acquired for a fee based on the value of the loan. Bearing in mind that the company is not regulated in any way by a UK or IOM Regulator, the company is entitled to charge whatever they wish for their services.

                The degree to which loan repayment demands can be resisted, is a legal matter. I am not a lawyer and am unable to offer an opinion as to the veracity or otherwise of the statement made. I suggest that you take such advice if required.

                Next steps

                If you choose to engage with Helpline Services Ltd then you do so at your own risk and you should undertake research to satisfy yourself that you are getting what you want and a price you think is reasonable.

                If you are unsure, then seek help from a suitably qualified source.
