    In my case (Winchester EBT), the scheme provider were dissolved (by Baker Tilly) and now Baker Tilly are the sole trustees (via a specialist trust company they own).

    It was Baker Tilly who employed THL. It was Baker Tilly who employed THL to chase beneficiaries, and passed them our data without telling us. It is Baker Tilly who are seemingly making getting accurate information about the trust as hard and confusing as they can.

    It is Baker Tilly who claim they cannot answer any questions because they don't have the "expertise or resources", instead passing you on to a company set up by an 18 year old just over a year ago...

    It is Baker Tilly who appear to have set up another company (DOR Resolutions Ltd) just to take payment and confuse that part of the process. DOR's postal address is a PO box in the Isle of Man, but from talking to them it is pretty clear they are not British, and probably not in Europe.

    I don't know how well Baker Tilly have covered themselves legally, but based on what i've found and my communication with Baker Tilly and all the companies they are putting between us and them, they do seem to be running this show.

    It may be different for other Employee Benefit Trusts.

      Well, I think THL and DOR Resolutions Ltd are just a pair of shady two-bit companies who are trying to leverage off the Baker Tilly brand in order to create a facade of integrity to their company image and scare people with their fictional corporate prowess in order to force them to pay up for God knows what. That is why they have to go to the trouble of paying for a virtual office as their company address, with no telephone contact to any actual person, it's all a facade.

        Baker Tilly (IOM) have confirmed that they are the trustees for many of the EBTs.

        DOR are wholly owned by Baker Tilly (IOM).

        THL were appointed by Baker Tilly (IOM) to be their sole representatives in this matter.

        Baker Tilly (IOM) have passed on the personal data of EBT beneficiaries to at least THL, DOR and ECS Trustees (IOM) International Ltd. No privacy notices were sent out when the data was passed on, in apparent violation of GDPR, which both the UK and Isle of Man follow.

        Baker Tilly (IOM) have allowed THL to make repeated vague, inaccurate and sometimes outright misleading statements, which HMRC has had to respond to.

        Baker Tilly (IOM) have been extremely uncooperative at all stages of this, going so far as to violate my written contract by not telling me they had become the trustees and been passed my personal data.

        Baker Tilly (IOM) are aware of multiple complaints made about them directly and to the IOM regulatory authorities, but have not modified their actions.

        Please be in no doubt regarding who is pulling the strings in this situation.

          Goodbye and Good Riddance

          So after months of increasingly alarming emails from THL they have disappeared with no trace leaving a website that doesn't link to anything and a forwarding message as follows;

          Looking for THL's portal to your trust data?
          It's no longer here.
          Our contract with your trustees has concluded, so the portal has been decommissioned and it's no longer possible to log in.
          If you were here because you want your trust loans written off, send an email to [email protected], quoting the reference from one of the emails we sent you. We understand that until 15th March 2019, DOR Resolutions Ltd will still draft the necessary paperwork and explain how you can get it signed.
          Any data the company held about you was returned to your trustees on 5th March 2019. We no longer hold those records. We're also no longer sending or receiving communications in connection with the trusts or loans.
          We're delighted to have been of service to your trustees and to so many of their beneficiaries. Our obligations are fulfilled and our work is complete.
          Thanks for your good wishes.
          About the service Helpline Services Ltd provided
          Helpline Services Ltd was hired by several firms of professional trustees to provide data administration and communications services. The company has now discharged its obligations and the contract has concluded.
          The services provided were:
          - validating the loans data supplied by the trustees,
          - presenting loan statements to the trust beneficiaries and agreeing any amendments,
          - drawing to the attention of the trust beneficiaries the 2019 Loan Charge legislation,
          - presenting options to the beneficiaries as to how they might respond to the legislation, including signposting settlement options with HMRC, how the loans could be written off, the availability of tax advice and the option of insolvency.
          The company has not provided tax advice, nor has it handled any of the funds paid by trust beneficiaries.

            Well I reckon it's a load of bull.

            Just like the other B*S* container company they created DOR group limited, company number 016054V on IOM company database.

            Using contrived structures to get more of innocent peoples money who they f* over already.

              I agree completely.

              Felt more anger over the last couple of months than in the preceding decade.

              But unfortunately (in this situation) morality and legality aren't the same thing.

                So some people handed over 5% of the loans for nothing? Did anyone get a receipt saying that the loan had been released?

                Would they have been just as well to take it out in cash a throw some petrol on it and light a match??

                  DOR Resolutions

                  I have emailed DORResolutions as suggested by the message on the link from THL.

                  They confirm that they can arrange for the Trustees to Write off 95% of the loan if I repay 5%. There was no information on how to do this or what the process would be. The email is just signed "Admin". Tbh it looks completely unprofessional and I have no confidence in the validity of their proposal.

                  I queried whether the 5% would then be available for disbursement to me, as the Trust is effectively holding my money. However, apparently the 5% would be taken as a fee to cover the costs of writing off the 95%.
