If you look at all the recent cases (Hoey, Higgs, Lancashire), it's all about trying to shift the liability elsewhere (deemed employer, agency) and claiming a tax credit. But that hasn't achieved diddly squat so far either.

I don't know what WTT are smoking, quoting a 60-70% chance of winning, but that sounds like pie in the sky to me.
Totally. That was what they said when they recruited Big Group members too. IIRC.

I didn't want to dishearten anyone by saying the same things as I know it feels good to have professionals on your side and to be part of a wider group.

However as many have said many times, no matter how good WTT (and the others are) and I don't doubt their skill and knowledge, but all you are ultimately doing is delaying the inevitable and paying someone to delay the inevitable.

IMHO you may be better served paying a professional to work out a settlement with HMRC and getting on with your life.

I’m another idiot thats been caught in all this mess. I started a contract back in 2015 and approached Aston Mae who set me up with a Ltd company whereby i would be paid by my agency and then i would need to send money to Glen May and they would then distribute the funds to my personal account or expense card. Continued doing that until Procorre came along and took over Glen May. Finished with Procorre in 2019, this is when i started receiving letters from HMRC and i started to get a bit suspicious with them as they kept hounding me with the acquisition which I didn’t go through. Anyway, everything went quiet over covid and then bang this year has come and last month i was hit with the Reg 80. The numbers being quoted by HMRC are quite astounding. Have forwarded to Procorre and didn’t get any response up until last week whereby they mentioned that they had acknowledged and would draft a reply back to HMRC. To date i am still waiting for this reply and the deadline to reply back to HMRC is within the next few days. I have in the meantime spoken to WTT and they like others have suggested gave me the same two options as described in the thread. I’m kind of leaning towards the appeal to HMRC where we challenge the figures in the Reg 80 (as i have no idea where they have got this number from) and then seeing where we go from there. I have also declared some of the profit share allocation in self assessment in the last few years which I’m hoping will bring the total liability down some what. Just want this nightmare to end and get HMRC off of my back!! Unbelievably stressful!

So you didn't go through with the sale of your limited company to them ?

No i didn’t. I found it all weird, that despite me saying no initially they kept asking me to go through with the acquisition. To be fair the alarm bells were ringing much before i initiated the exit out of Procorre and just wish i acted upon my gut instinct at the time.

I can only suggest, going back over all the payments you received from Procorre into your personal account between 2015-19, adding it together with your income in 2018-19 and working out how much tax you should have paid. You can then argue with HMRC what you have already paid due to the PS allocation should come off that, but someone like WTT can assist with your appeal.

Whether you argue what that amount of tax should be settled is entirely up to you, but at least that way you will have a more realistic figure on what the tax is on your actual income, rather than this assumed/mythical figures HMRC appear to be coming up with. It probably still won't be a nice figure, but it may help reduce some of the stress. Good luck

Mine was done and dusted in around three months, including negotiations for long TTP all pretty straight forward really. I did have assistance from tax specialists.
