Random Drug Testing

How can this be anything other than bad from an IR35 point of view. Client Co have dictated that everyone on site regardless of who they work for are subject to random drug searches. A failure to either give a sample or a failure of the test will lead to banning from site.

Don't mind taking the test this is a building site after all with a lot of dangerous machinery but just seems like its another possible way HMRC could stiff me if they wanted to.

No its a health and safety issue for the location including all contractors and consultants from multiple companies.

Don't assume everything is an automatic IR35 fail.

I know its not, I'm not that worried about the drug test - this was more of a rant that I feel like everything HMRC will try to stiff you as IR35 on. Almost like you have to walk on a permanent state of readyness in order to fend off the inevitable IR35 attack.

Can't see that this will have any bearing on IR35. If you do any work as a contractor, permie or sole trader on the railways, you will be subjected to this. It's health and safety (in a good way), nothing more.
