Having had a new head teacher in place at my kids school who has had the audacity before the holidays to send out a letter saying that it is illegal to take your children out of school outside holiday times and that they would not OK any requests

You realise term starts 1 day later than you think it does? No rule says terms always start on Monday! The teachers start work one day earlier than the kids, just as you are requesting.
