The pilot is responsible for checking the condition of the aircraft before every flight. So that could indeed be classed as pilot error.

This article mentions two incidents, I'm sure I've seen more on 'Air Crash Investigation' which I always find myself watching when on holiday.

But you know it all so who am I to argue?
Science isn't about why, it's about why not. You ask: why is so much of our science dangerous? I say: why not marry safe science if you love it so much. In fact, why not invent a special safety door that won't hit you in the butt on the way out, because you are fired. - Cave Johnson

          http://www.boeing.com/news/techissues/pdf/statsum.pdf

A study by Boeing determined the primary cause of Airline hull loss accidents (worldwide commercial jet fleet), from 1996 through 2005, to be:

          55%: Flight crew error
          17%: Airplane
          13%: Weather
          7%: Misc/Other
          5%: Air traffic control
          3%: Maintenance

That study included 183 accidents, with known causes for 134 of them. The remaining 49 were unknown, or awaiting final reports.

Previous Boeing studies showed higher rates for Flight Crew Error:

          70%: 1988 - 1997
          67%: 1990 - 1999
          66%: 1992 - 2001
          62%: 1994 - 2003
          56%: 1995 - 2004

          HTH.

You really are in the Village Idiot category, aren't you?
Maintenance and ATC account for only 8% of accidents, thus proving my case

I suppose they find it hard to do a new season every year as safety improves.

This was quite a memorable one, too many short hop flights contributed to metal fatigue which caused it to open up like a sardine can.

True, but 3% is still greater than the one case you cited.
