Lawyers do not have scruples, try googling "Schillings". They (lawyers in general) are a bit like contractors, if the rate is decent enough, we'll say and do anything. His heart is in the right place - shame we can't say the same about his brain... -

See Gladstones.I'll happily stick with the filthy world of entrapment being a nasty way of doing business and can't way to see which law firm fancies tarnishing its name by being party to what is tantamount toextortion with menacesissuing a private parking ticket.Comment

Everybody is entitled to legal representation even if they are a crook, and their legal representative is a crook.Originally posted by Mordac View PostLawyers do not have scruples, try googling "Schillings". Remember, it's up to the copyright owner to prove who has committed the infringement. You can't take an address to court. Literally impossible to prove which individual did/didn't download anything.Comment

That is not how the civil courts work. Judgment is given on the balance of probabilities therefore, if there is a 51% probability that there was an infringement the courts will give the Claimant Judgment. Moreover, the probability would be that the subscriber to the ISP would have caused the infringement.Originally posted by Agent View PostRemember, it's up to the copyright owner to prove who has committed the infringement. Sorry, you're way off legally. The claimant has to prove that an individual (who may or may not be the account holder) illegally downloaded content to which the claimant holds copyright. If they can't prove that, they will lose. Oh, and for Christ's sake, learn how to spell judgement.Originally posted by Paddy View PostThat is not how the civil courts work. If it's a civil case the claimant has to prove there is a good probability the individual did illegally download the material.Originally posted by Mordac View PostSorry, you're way off legally. If it's a criminal case the claimant has to prove without reasonable doubt the individual did illegally download the material.
As Goldeneye are using the civil courts you don't have to have done the actual act there just needs to be sufficient evidence to convince the judge you very likely did do it. In other words I agree with Mr Judgment."You’re just a bad memory who doesn’t know when to go away" JRComment
