              Interesting stuff. Does this is mean the defense of Substitution and MOO are now dead against IR35?

              As they can transfer the liability to the end client only on SDC failure now no client is going to touch an outside IR35 PSC!

                Not sure about that, in terms of clients working with outside IR35 contractors. If the online test shows outside then they will be outside and that should be fine. Could be that clients will be able to indemnify the risks somehow...

                  Going by what is in the article, at least it's not as bad as I first thought more work on my part to ensure the client is more educated but none the less not a showstopper.

                    If HMRC come out and say that they are happy to accept it as a defense then that will be great, no more uncertainty. I will not be holding my breath for that statement!

                      But we know HMRC are failing already, small number of investigations, small number of wins - they just don't have the resource. If they manage to get a "Computer says no" system that works and they can show their masters that it works then why the heck not.
