    Of course they can. You know it's an error on their part, you accept the contract based on that basis, they can terminate the contract without payment.

    Either change it yourself and send it back or get them to reissue with the right rate in there.

        I would be professional and point out the mistake. My reputation means a lot to me and I'm sure has resulted in repeated work from clients and agencies.

        You could always try it out and see if they pay up

          Bill for it - they terminate the contract. The contract was always void, since you knew it was a mistake from the outset. You then have a battle to get anything paid because there was never a valid contract in place.

          Ignore it and bill correctly - paperwork doesn't match the invoiced amounts

          Get it corrected - things run smoothly, but you miss the opportunity to look like a prick by trying to charge £400 an hour because of the mistake.

          Your choice.

                  Do it right. What's the point in trying to scam this? You might get away with it for 1 invoice, at best, then after that? You've got no contract anymore.

                  I once filled out a time sheet for a 5 day week and I'd just completely forgotten that I only worked 4 days. The client also forgot and authorised 5 days. It was only at the point of invoicing that I realised the mistake and I pointed this out to the client straight away and did it correctly for 4 days. Ok, I could have been a day's pay up, but what if the client had spotted it before me? At best I'd have just looked incompetent.

                    If you seriously think that any agency will blush, say 'oops my bad' and then agree to cough up £400 x 7 hours per day without a fight, then I say go for it.

                    I would also say steel yourself for the possibility of being made to look a complete tw@

                    People make mistakes.

                    Ring them up, point out the error, share a chuckle and move on.

                      Whilst I don't disagree that, once you know there's an error, it's really just best to ask for it to be rectified and smoothly proceed from there, however, I do wonder about the situation whereby, if the shoe were on the other foot and it was your mistake in a contract clause that benefited the agency, would they be so forgiving?
