It would be interesting to know what happens to that money if the umbrella chase for a late payment and get it - would they be nice enough to pass it onto the employee, or keep it for themselves?

Guess it depends on the umbrella - of course, would the employee ever know that they had received the money in the first place?

I did respond with more details (see earlier in the thread, it seems that the moderator posted it after you had responded)

The umbrella company in question is in the top 10 on a lot of websites but I would never use them again. I wouldn't use that agency again either. Awful service and lack of support from both of them.

Currently I have no idea when I will get paid as neither of them and taking calls or responding to emails.

Any decent umbrella would pay out the money on the same day that they received it and it could be confirmed that it was for that contractor i.e. they had a remittance advice or the invoice number quoted on the payment advice.

The explanation for late payment certainly doesn't seem to be satisfactory and I would urge the OP to contact the umbrella again and ask them to press the agency for more info.

With regard to you comment about it not being in the brolly's interest to chase payment - if the brolly is operating a proper over arching contract they will make payment to the contractor at the end of the month regardless of whether or not they have received funds - if they then don't get paid that's lost money

I'm not sure how this would make a difference given that it's the agency that is holding onto the money.

he means to take control of your own situation and not have a company between you. If you were LTD you could go in all guns blazing with threats of interest payments etc etc. At the moment you have to leave it to someone that probably isn't quite as driven as you.

He also means to improve your take home and control your finances in general. You must have lost a lot of cash if you compare LTD vs Umbrella.

The critical question is: Who can you sue for the money?
