    will hit 24months at end of the year, some advice. not expence related

    Hi All,

    Been of the site for a very long time due to new addition to my family house move etc...

    Anyway my current gig was initially 6 months and rolling ever since. Approaching 24 months in Dec13/beginning of Jan14.
    Most of the projects are done and whats remaining is basic stuff that could be handled buy the perm team in Stockholm. Also code freezes etc.

    I think client assumes i'm just going to carry on rolling, but I thought id get some opinions first.

    Should i just put it to them after 31st Dec 2013 will they require my service and if so a new contract to be arrange?

    or should i walk.

    not interested about expenses as i know from next year were ever I contract with travel is out my own pocket as live in surrey and client's will always be in London unless i start going away again. only travel abroad a few times a year now.

    just want to get peoples opinions really. im not based on site i just come in for meets, implementations/ roll outs etc. do most of my work from home.

    its a good gig financially, but after 24 months should i move on or re-negotiate. could be that they are looking to end in Dec but i just want to have my head all clear so I have the reply ready when I do approach them next week.

    not sure of any other issues I may face as I'm only on site a couple of days a week at most on site so outside IR35. But charge them a daily!

    On/off site doesn't impact IR35. It does impact expenses though - if you're not on site more than 40% of the time the 24 month rule doesn't apply...

    Otherwise ,why give up a cash cow, especially if it isn't very onerous? Why not look for another gig and keep this one on a T&M basis?

      If you want to stay and there is no contract, then you need to get them to arrange new paperwork. If you want to walk, then remind them that your contract ends at the end of the year, and discuss whether the format of your handover.

      If you spend the majority of your time away from their site, then you don't need to stop claiming your travel and subsistence expenses. Read up on the rules.

      Why are you asking us? Do you want to move on or do you want to renegotiate? Have you got anything else to go to?

      You do know that the amount of time on client site has nothing to do with IR35, don't you? You may be outside IR35 because of other factors, but whether you are on-site or not isn't one of them.

        yeah you could be right,.

        I''ll approach them to say next year if they want me then new contract outlining what is required of my service.. if they haven't decided and only to roll then ill walk as asking to up the rate is not really going to work. on a really REALLY good day rate.

          What has your personal life got to do with how long you are in a gig for? We assume from the post that this 'very long time' is just less than two years. Not really a long time.

          Is it really a rolling contract or is it 6 month periods with renewals? Do you have to sign new contracts every 6 months or do you just carry on as normal. I think you could be in a bit of bother if it is automatic renewals.

          What? You said you are on a rolling contract and they assume you are going to stay. Why do you need to put anything to them?

          I kinda gave up here. This doesn't make any sense, particularly when you say it is a really really good rate. If you are saying you have been there two years and you want a change or break then maybe worth not saying 24 months as this causes confusion with the expenses rules.

          It would be useful if you clarify your exact contract terms to us. 6 month renewals or some kind of rolling contract.

          P.S. You might try a few capitals in your post if you are really asking a serious question and want a serious opinions.
