    So they want

    opt-out of the Conduct Regulations...

    long list of references, no doubt for the fishing for sales they will go through hassling these poor people

    opt of of data protection act protections, ie they can process all your personal data in India

    before putting name forward to client

    oh and if you want to use an umbrella it must be their chosen one (parasol)

    how do they get away with this ?

    As far as I understand it, you can only 'opt-out' of marketing restrictions, not data protection per se.

    I would ask the Information Commissioner’s Office about this and send them the details. I'm not sure that this is legal.

      It's even worse when you are in - too process-bound to be of any real value to the temp /immediate start market - will hassle you constantly for any item not ticked on their tick box list - had to apologise to the their staff for calling their process bolloxs after the 3rd hassle call of the day and a consequential

      IIRC they did pay on time which was a redeeming factor
      How fortunate for governments that the people they administer don't think

          I worked through them for two IBs over a three year period and they were fine. Always paid on time too. But that was a couple of years ago; in recent times, they really seem to have gone downhill. For example:

          1. They arranged an interview for me with a client. Only they forgot to inform the client! Good job I'd insisted on a telephone interview...
          2. Two weeks later, they've put me forward for another role - without seeking my permission. I finally agree, though, and say I'll do a telephone interview the following day. I get an email from them later saying they've arranged a face-to-face for the following week! And to cap it all, the job spec. - when it finally turns up - is absolutely nothing to do with my skillset and nothing to do with what we discussed on the phone.

          So, on recent performance, AM have slipped hugely in my opinion.

            What happens is that you sign a document allowing the information holder to hold and process it outside the EC. It is fairly standard with multinationals and/or their agents and not illegal if the formalities are correctly observed.

              It is not "fairly standard with multinationals" unless you mean those slave trading Indian outsourcers, Tata, Cognizant, Infosys, and the rest. I have never come across it in any other walk of life other than recruitment agencies. And for me it tells me all I need to know about the standards in play at that recruiter, lowest cost possible, outsourced to some hell hole of indentured servitude and no data protection rules in what its own head of anti corruption called the most corrupt country on the planet.

                Wow just seen the Capita "candidate registration form"...

                Asks for everything short of my inside leg measurement and bank card pin number.

                What silly people, thats another decent candidate that will just give them a miss, and when I am back in the recruiters seat will be crossing off my list of agencies to call.

                  The fact is you give them all your data, it's pumped into a database somewhere for a management accountant to report on or for the PR team to write articles about the increase of xyz!
