    Contracting without an agency?

    Hi, so I find this project via grapevine and not through an agent. Who will I be signing a contract with, is there an IR35 implication, mortgage availability (still an IT contractor ) and any other else I need to be aware of? If I need to have an agency in between any recommendations here in London?

      Thanks. Read again, and over again. I roughly understand the opt out idea. Do you suggest that the stickie also covers the process of signing a contract directly with a client?

        You are a business dealing with another business. It doesn't matter what that business is, IR35 will always apply. But clients are less used to having their contracts questioned so this needs a bit of diplomacy and forewarning.

        You are more at risk with client cash flow issues (using an agency usually eliminates this, I'm happy using agencies for their factoring alone) - if you get less than 30 days payment from submission of your invoice you are doing well.

          I contract direct with my Client, who pay between 21 and 28 days from invoice. No Agent involved and it got me a high Daily Rate than if I had gone through an Agent.

          The Business Risk is higher than if you were to use the Opt Out/In decision based scenario, but I am quite happy that my Client won't go Bang! on me (Bank of England ).

          Works for me and I am happier that way.
          I was an IPSE Consultative Council Member, until the BoD abolished it. I am not an IPSE Member, since they have no longer have any relevance to me, as an IT Contractor. Read my lips...I recommend QDOS for ALL your Insurance requirements (Contact me for a referral code).

            PCG templates

            I usually contract without an agency. I'm a member of the PCG so use their templates to set up the contract with the client.

                I contracted direct for the first 2 years with 3 different clients and no agency in sight. Never had a problem.

                    Main bonus from an IR35 perspective is that you don't have the 'upper level' agreement between agency and end client to worry about. This is something HMRC will often try to attack as they know the contractor has no control over it and, in many cases, the upper level terms completely contradict the contractor-agency agreement.
