Regarding Opting out of the "Conduct Regulations 2003"
I have been contracting direct to a client for several months, but have been having issues getting paid on time. Therefore I have asked to go via an agency of my choice and the client have agreed to pay an extra sum per day to cover that.
Now the contract from the agency specifies that I must Opt-out of the above regulations. Now I am going to negotiate that, and I dont think they can legally force me to opt-out. I want to opt-in to help protect me against the client defaulting on payment to the agency. I believe the opt-out can only be done before the introduction of the consultancy to the client. How does that apply in this case where the introduction has already been made through some method other than the agency?
