    Buying out of a long contract

    (Noob forum member, I'm sure this question will have been asked before but I can't find an appropriate thread...)

    I've been in a contract under an agency for 18 months, I suspect I can get another extension and want to come out from under the agency umbrella.

    Can the agency legitimately stop me from leaving their contract and signing my own contract with the end client?
    If they can, what would be a reasonable fee for them to charge to buy out of the contract early?
    Has anyone had any success negotiating a buy out fee?

    It won't happen - it's been asked many, many times before.

    The client won't put you on the PSL and the agent will just replace you. Why would the agent negotiate a good buy out fee? Its in their best interests to keep it massivly high and won't lose out if they don't agree to lower it.

      What do the conditions in your t/cs state ? Is there a termination period clause stated in here ? If so you will have to work within these limits and to which the agency can legitimately stop you from leaving them.

        You want to be looking for the handcuff clause in your contract and it has been asked thousands of times. Go look in the welcome section and the sticky about how to search the forums using google. Then do that using the term Handcuff

          read your contract, mine states if i go direct with the client witin 6 months of leaving the fee is three and a half grand

              That's cheap

              Mine says £15K buyout (or a 6 month wait, like yours).

              Have you ever thought about just paying the agency the £3.5K and going direct with an increase in your rate?

                First step is to ask the client if they are even interested in this arragenement which in most cases they won't.

                  I had problems quitting an agency even when they owed me 3 months money for a client requiring SC clearance...and still didn't get around it. Ended up doing a companies house search for the agency directors' home address and indicating that I could drop the written complaint to them personally on xmas day if that was convenient. They paid and I handed in my notice.
