    What can i do in this situation (URGENT)

    Hi Guys,

    I am an IT contractor. I recently got a contract from an agency. In the initial rounds of negotiations they send me a contract draft which has a clause that I can terminate the contract giving some notice although they did not mention the notice though I got it verbally as 2 weeks and was waiting for the updated contract.

    Meanwhile I had to resign from my current job in order that I join the new job as well as serve notice period in my current job. Yesterday, the agency came back with a updated contract and had a clause added that my limited company cannot terminate the contract anytime during the contract duration.

    I obviously gave them a call to amend this but they are reluctant. Is there any way I can pressurize the agency to remove this new clause.


    Please let me know your comments. Its a little urgent.

    How long is the contract for? If it's just for 3 months I'd accept it.

      Some large companies do this so - as Cojak said - I wouldn't worry if its a short term thing. If it's six months then get it amended to a three-monther.

        If it's that important, just tell them to stick to your agreement of 2 weeks notice or you're not doing it. Faced with the choice of (a) definitely having to find a replacement now with no notice at all, and (b) possibly having to find a replacement at some point in the future with 2 weeks notice, the agency might prefer (b).

        I wouldn't though. If I was engaging a supplier who insisted on the right to pull out within a fortnight I'd go looking for another one.

          Dunno why but we all seem happier if we have a notice clause and more so if the agent \ client has one!

          As has been said, if the contract is only for 3 months, why bother? I've arranged to take a weeks holiday for the last week of my contract so I can start another one earlier.
          I couldn't give two fornicators! Yes, really!

            You shouldn't have resigned until you got the contract and signed it. either accept the terms of the new contract, negotiate it based on the original agreement or walk away.

              Who's the end client?
              I signed a similar contract, rolling 3 months no notice period.
              Something better came up 5 weeks in so I spoke to end client who were very reasonable about the whole thing.

              I told them whatever happens I wouldn't be renewing which would have an impact on the project as I'd be far more ingrained and hard to replace by then and obviously from their point of view they don't want someone working there who can't wait to get out and is bitter from missing out on another opportunity.

              They served me about 2 weeks notice. Actually it's 12 full working days but I can feel a bit illness coming on towards the end of the last week.

              In short ...sign it

                Who needs a notice period? Either stick it out to the end of the contract or if you have to leave sharpish just go and hit some **** at the watercooler.
