Contract Cancellation

Hi All,

I have just accepted a contract last week due to start soon (Have signed this contract but not started yet).

Today I have recd another contract which is more local to me.

Can I cancel my 1st contract (already signed but not started yet) & accept this new more preferred contract.

Can the agency take any action against!

Without knowing the wording of your contract, I can't give you an answer that would be wholey correct. Therefore I will say the following:

What does your contract say?
Speak to the agency and tell them your situation and see if they are prepared to terminate the contract with or without penalty.

Be prepared to receive a lot of flack from other posters.

Normally I'd say its not very professional and berate anyone who did that sort of thing as it gives contractors a bad name.

But in this climate I'd say do whatever it takes to look after No.1, I've been pissed around and exploited so much in the past 18 months I don't give a flying flip anymore.

Now I will predict the rest of the thread....

Some people (myself included) would advocate that you have a legal and moral duty to do the first contract. Citing such examples as "how would you feel if the client cancelled at the last minute..." and "how would you feel if you engaged a plumber and he cancelled at the last minute because he had a better job..." You signed the contract, so go do it - people who don't help to drive the whole market down.

Other people will then say "look after number one" and "clients do it all the time, so just shaft them and take the one you want". They will then tell you that there is no chance that the agency will take action against you, so it doesn't matter.

The first lot will then say "ah, but if you are in a niche field, your reputation may suffer" and "just because clients do it, doesn't make it right for you to do the same" and "how do you know the agency won't take action?"

The second lot then say "if I had a pound for every time I've been told that I'm on an agency blacklist, I'd be rich"

Then you will take the second contract, because you have heard the answer that you want to hear (and can safely ignore the bits that you don't want to hear).
