    What is the issue here exactly??

    When I contract a builder to put me up an extension on my house, I expect him to finish the job and not tell me he wants a notice period added to the contract in case he changes his mind half way through. Thats not how contracts work.

    Why would IT folk think their world is different??


    Sounds like yet more disguised employee malarkey to me.

        It depends who is inserting the no notice clause ! If it is the client then so be it, if things aren't good on site for whatever reason then you talk to the client and agree a way forward, and get it in writing if they are happy for you to leave. If it is purely the agent and it is also backed up in the contract with tulip about making good their losses if you leave early, then you are a mug to sign up to a long contract with no notice period in IMHO.

              I have had three contracts (out of loads over 17 years) where there has been no notice period on my part (ie I can't leave) but the client can give notice. Every one of them has been horrid, the client knows this and doesn't want the contractors to be able to walk when they see the mess the project is in on their first day.

              I take it as a bad sign now and have turned down a couple because of it.

                Building is a profession with one set of standards and expectations. IT is another - with lots of variance within it. The builder/plumber analogy is not only overworked, it doesn't apply.

                  As they say, the length of the contract is the length of the notice period given by the client. My current contract has zero notice period so I could go into work tomorrow and be shown the door.

                  Not ideal but a number of large organisations do this and I find it's better to bite the bullet and take the risk.

                      I have recently started a new contract that has no notice period on either side, but neither does it have an end date. QDOS have approved it as IR35 compliant. I assume that the client can bin me any time he feels like it and I assume that I can walk away when ever I please?
