6 month contract is actually 3 months?!

    6 month contract is actually 3 months?!

    I signed a 6 month contract with the agency with 28 days notice from my point of view, but they called the client and declared that it was a 3 month contract expiring next month.

    If I leave at end of 3 month and don't get/don't take extension can I sue the agency?

    Is the notice from the agency (to you) 28 days? If so, they can get rid of you.

      I don't get it. Why would they "call the client and declare" it is 3 months. Why would the agency want less...

      If they have any kind of notice then they can invoke that. As has been said before, your contract is only as long as your notice period.

      If not, then it might be possible to sue. It's quite difficult to do that - usually because of the terms of most contracts, which are heavily worded in their favour.

      There may well be clauses like "if the client doesn't pay us, we don't pay you", so they can just turn around and say they haven't been paid - and you can't sue the end client because you don't have a contract with them.

      None of it insurmountable, but they can reel off clauses that will make it very tough to sue.

        according to my contract it's until November and the agency has to give me a 28 day notice if they want to terminate it sooner

        but I actually want to leave the contract in august anyway, but that's another matter

          You want to leave in August (which is next month) and the agency has told you your contract now expires "next month" and you dont know what to do?

              Sounds to me like the client has binned him off.

              With over 600 posts behind him, he should know a contract is only as long as your notice period.

                Just leave then if that's what you wanted. It was probably only ever a 3 month contract by the client, but the agency stuck a 6 month tag on to make it more attractive. Either that or the client is binning you early which is understandable given your rather puzzling remarks about 'what to do' = try to scam some money from someone.

                Why don't you claim employment rights while you're at it.

                    Well what else did you expect with such odd postings.... You said in a different post that you want to leave because it's "dull" and you're "loaded" and money isnt a factor for you..... but then you talk about suing the agency because you're being canned early with the notice period stated in the contract (that you signed up to).

                    So it sounds like to me that money is a factor you.... money that you don't have to work for that is.
