At the end of the day, they were only ever going to get a few bob out of your month's pay. Let's say max. £100. If they ever come sniffing around, pay that and no more.

So, be bold, slip your moorings, speak to the Client and explain all, they'll see your side of it, and get another brolly.

P4 must now be screwed. Even if their books are legally OK - there'll be an exodus going on NOW, and they're surely pimpum non grata for the Contractor community for good.

My info comes second hand from a friend who used to work in an agency, so you maybe correct. My downstream agency is very good and pays the next week, so I've never had to wait for payment.

i would cut and run so fast it would not be funny - any service company that goes into administration is not good news. i work through an off shore provider and they have been spot on at all times.

            My view is as follows:
            1. How much of your money are they holding?
            2. Can you afford to loose it?
            3. Do you really want to risk giving them even more of your money to hold?
            4. Can you afford to loose what they are currently holding + more money that you pay into them?
If the answer to 2 or 4 is no, get out quick.

As for the contract situation you will probably need professional advice but you should be able to terminate the contract with an umbrella quickly and easily, how else would people switch umbrellas and change from umbrella to LTD mid contract (A lot of people do this)?

I am not saying that you should cut and run straight away, i'm saying evaluate the risks and decide accordingly, I have a feeling that most people will not want to gamble thier hard earned dough though and are likely to want to cut and run quickly to ensure that if they do loose anything it will be minimal.

IMHO you would be mad to keep invoicing and sending them more money until you have a clear picture of what is going on, all you are doing is increasing your potential losses.

I'm just waiting on official news from the Agency on my options. I'm not putting timesheets in and will try request payment of monie owed. It's not a massive amount, but enough to get worried about.

The worry now is if there is a mass exodus then this will certainly bring P4 down. That said, I have still decided to leave and go elsewhere although I'm taking a gamble as I work a months in arrears.

I very much doubt that it's a case of "if there's a mass exodus".

Get out, now, and be serene.

Good point - if all I am likely to owe are my fees if they disagree with a retrospective move then that'll be a risk I can take! Need to get my holiday fund out of them though, that might be tricky after I've legged it!
