    IT contract

    I signed an IT contract and the contract is outside IR35.

    The contract should have started on 12th March 2020 but the agency delayed the start date verbally to 16th March 2020(not in contract) on 11th March(i terminated my previous contract on 11th March) saying because of some minor problem .I said Ok to it.

    Now they haven't started my assignment yet and saying it will take take two more days or week to sort the issue.

    The issue they are now saying because IR35.The client is not agreeing that the role is outside IR35 and the contract was signed as Outside IR35.
    Agency said after a week also ,I am not sure the role will be outside .
    Please let me know what option/action I have.

    You are looking for an answer we just can't give you. It's inside. End off.

    You signed a contract outside.
    No work appeared but contract is running.
    Client now determines from Apr 6 it's inside.
    You'll work outside. Up to 6th and a new contract will be issued inside.

    But none of that matters. Its inside now and the fact they say this means it's been inside all along.

    Up to you what to do now.

        I can't take any legal action as they are not even issuing me an inside ir35 contract and because of this contract I had to terminate my previous contract(loss of income)?
        Won't I get paid for cancelled contract(because of termination clause in the contract)?

          What do the following clauses in your contract say:
          The termination clause about compensation that you'll receive
          Any other clause relating to what you'll get paid for
          The greatest trick the devil ever pulled was convincing the world that he didn't exist

            No other clause for paying.

                    If it's a week's notice, you'll get nothing. You get to work a week but they aren't obliged to provide work so reality is you'll get 40p rounded down to the nearest quid.

                    If it's a week's pay in lieu of notice, that's different. Have a good read of your contract to understand what it is.
