Eh? Surely those changes put you well inside IR35 =\ I understand investigations are based more around working practices but still, the contract has to be taken into account surely?

Working practises trump the contract, but yes the contract is the first piece of evidence and needs to be as tight as possible.Originally posted by mattfx View PostEh? Hence why I said "So it's back over the fence."
I've thrown it back at Legal to get amendments done.Comment

Hmm. OK you know enough about all this to make that call but my final point would be, they have no idea of IR35 and working your working conditions but they have a good idea what they want. That's a contract with a named person with no RoS and under D&C. No amount of you educating them to pretend to want an outside contractor will help surely?Originally posted by ChimpMaster View PostLegal have no idea of my working conditions because they haven't even been to the client office in England, nor to my main place of work (my home/Ltd address).'CUK forum personality of 2011 - Winner - Yes really!!!!

If Legal were aware of the consequences of IR35 for their own company then they would surely think twice. Legal probably think they want a pseudo-permie-tractor but the team on the ground in England doesn't and they haven't had that for the past few years. To them it's just paperwork and they're probably wondering why I'm making such a fuss.
It's like they've left half of the good clauses in and taken out half. Just plain stupid if you ask me - probably some part-qualified legal temp working on it.Comment
