But they don't need to pay a middle man/consultancy anymore, the PM's can run their own projects without the consultancy politics.

It could be a foolish question, but does IR35 in any way apply to larger consultancies that supply bodies to the client but in terms of the 3 pillars and respect them only partially? Sure they have the right of substitution but direction and control is always there...

Substitution is all that is required.

It could as easily be a foolish answer...

If not following the 'guidance', or lack thereof from HMRC, and then following the 'trend' as started by the banks, so long as the large or indeed Any sized consultancy does not use PSC contractors then all this IR35 stuff is not in any way relevant to consultancies or their clients.

They receive an hourly rate for bum on seat type of contractor. About 30% of the rate goes to consultancy employee and rest to the company. I would surely like the full amount to be taxed as it is in our case. And their contract and practices with the client are in a very similar way like ours. Question is, if that is the case, why it is not affecting them?

Only being about substitution, sounds a bit too little.

Does it really matter? atw has never been a contractor - he went from phones4u (as a permie) to majestic without contracting at any point.
