    Notice Periods

    Hi All,
    Quick question, If I serve my notice (which is 4 weeks) can the company then serve their notice (1 week) ?

      What makes you think they can't?

      I expect they can taken your work off you and ask you to leave there and then.

      Read your contract and understand it.

        Well that reminds me why I do not frequent this board at all, I had searched but found nothing of similar note.

        I only asked as there is nothing in the contract regarding this situation & only detailing the notice periods.

          There has been a great deal of discussion about notice periods. If you frequented these boards you'd know it. Here's a lmgtfy to show you how to search rather more effectively than the vbulletin search function.

          I'm puzzled why you would have any doubt that if you gave 4 weeks notice they couldn't turn around and give you one week notice? I've worked on (and hired people on) contracts where the contractor has no notice period (obliged to work full contract) and the client has a zero day notice period (sorry, danch, we don't need you any more - goodbye).

          Why do you want to know? Idle speculation or are you planning on giving notice and worried they'll can you forthwith?

            Finding only the notice periods is your answer then. No restrictions about giving notice so it's open season.

            Why you might find in your contract is something saying you only get paid upon receipt of a signed timesheet. If the client decides to take you work off you there and then you won't be able to put any further timesheets in so effective instant dismissal. No permie rights or anything I am afraid. Luckily enough most clients either don't know this or are not that cut throat to pull it so often... but it does happen from time to time. Either that or they will make something up you did that constitutes gross misconduct and walks you. No recourse there either.

              Not sure why. It's not unreasonable to guess that notice periods have been discussed to death on here as every contract has one so the information will already exist somewhere. It's also not unreasonable to expect that you won't get a full blown answer to something that is discussed a lot. It's free information so it's not going to be as good as you'd get from your accountant et al.

              You've had some direct feedback on your question plus a little snippet of info about the usefulness of notice periods so you've got more than you asked for.

              Why should that be a reason not to frequent the board?

                I know it's off topic for these forums but is the same true for permanent positions ? Is there any decided case law regarding eg an employer giving notice to an employee after the emloyee gives notice ? Just curious...

                    It's generally more balanced in permie land isn't it?
                    Either with matching notice periods or some clause where 'gardening leave' is invoked. I think the unfair dismissal tribunal would be more hassle and cost than just buying out the notice period.
