    contract termination

    So here's My question.....

    Notice period is 4 weeks in my contract

    I've provided good services during my time with client.

    I have positive reviews to my manager and also agency for the whole time I've been there, as recently as yesterday.
    Today the news is that I'm being terminated for poor performance. Based on....... Nothing.
    19 hour days etc completely uncharged.

    Now apparently poor performance can be immediate termination with no payments, but they've agreed to a 2 week garden leave, in " good will".

    Where do I stand

    I'd assume there's a case here to seeing out my notice of 4 weeks.

    Take the two weeks money and run. It is all you are going to get.

    Next time, don't work for free. Clarify the hours required and deliver on that basis, if they want more, then renegotiate. Why did you need to put in 19 hours a day anyway (does that include your travel time? - If it does, you are not being completely honest with yourself).

        Eh? This makes no sense. You posted this a few days ago

        So i have recently started a new contract and so far nothing has gone right, 2 weeks without IT and now i have it, the demands i am faced with are completely unrealistic. Not even a little bit.... i mean VERY.

        I think i'm already being forced out, either through these demands or other reasons.....

        My contract states a 4 week notice period on both sides, but what are the conseqquences for each party if one of us was to terminate early?

            So come on OP whats the true story here?

            If this is the true version I would say:-

            1. Getting terminated. tulip happens they might make any old crap up just to make it easier to get rid because they've decided they want to.

            2. 19 hour days. Hope your talking one-off here. Even then I'd be hoping for some good will in return off client. If its regular then you're a mug. You've just learned that clients dont care - work 24 hours - if they decide your gone your gone.

              Yes, there was a distinct whiff of deja vu with this one so I had a look at the previous posts and saw they were deleted.

              OP, contracting may not be the life for you. Looks like they terminated you before you could terminate them lol. Be grateful for the two weeks notice.

                Guess it's another case of the OP not getting the answer he wants and try again. As PC says something isn't starting to fit. You're underhand posting history deleting and re-posting kinda makes me wonder if this is a flag of greater things. Are you like this at your clients?

                Doing 19 hours a day isn't a good thing. Permies could worry they are putting themselves at risk if you are doing this many hours. Are you gonna crash your car on the way to work next day through being tired? Accidents at work, not being efficient the day after through lack of sleep? Is he worried it's going to come back and bite him. Doing that many hours isn't clever and I am sure isn't required. He is paying you for 8 hours good solid work, some people do a few more because it's their work ethic, others don't but clients can still be very happy with the work in that time frame. I am wondering if these long hours are actually working against you and not for you.

                  It's not exactly duplicate though, I was asking what happens if I walked out, and now I don't have that choice.

                  The previous content was deleted because I thought, if it had been seen, I would be out the door based on that.... Stupidly used my real name for username

                  My problem isn't being terminated, because I was close to walking anyway, as the previous post shows, my problem is being told poor performance is to blame, when for my entire time with the client I've been reported to be doing an excellent job.

                  And I've been contracting for a long time, and never had this before.

                    Why would you walk out now when you've been given 2 weeks goodwill? I'm confused.

                    To be honest if you are being canned for poor performance you are probably doing them a favour so they won't come after you for breach of contract or anything.

                    Why do you think there is a chance of seeing the 4 weeks out when you have already pointed out immediate termination and you've been given a favour of two weeks?
