    Company changed the contract after it has been signed

    hi all,

    I agreed a contract -via an agency- and I sent the signed contract to the agent on Monday - due to start on the 29th.

    The company now came back - via the agency - asking to remove some of the perks that we agreed.
    Now that is not on. The agent said that they can do that, cause the contract is with the agency and not with the company.

    What do i do?
    Help please!!

    Next time make sure you both sign at the same time. Or at least, make them go first.

      If the agency is in breach (with yourCo) then you can just find another gig.

        Obviously yes, but what do I do now?
        Apparently the excuse given is that the director agreed the terms and now there is a new manager that wants to remove some stuff..

        The agent was always agreeing to things with the company and after he finally agreed everything, send me the final version so I can sign it.
        Can I go against the agency?

          Very simple, a contract is between 2 entities agreeing terms and conditions.

          Tell them to send you the new contract, you'll review that and if you don't agree you'll reject and drop this contract.

            Tell them you want the contract as you signed it. If they say no, walk away and get another gig.

            What is the 'stuff' they want to remove?

              Erm, exactly what perks are we talking about here? Never heard of a contract with perks in it before. It could be he is quite right in removing them depending on what they are. Just hope they aren't MoO and RoS!!

                    What can you do? Point out that you have an agreed contract with the agency - what is agreed between the agency and the client is generally none of your concern (until you find out that they wouldn't allow a substitute and bugger your IR35 defence, of course )

                    If the agency wants a new contract, then you start the negotiation process again - you then either accept or reject the contract terms, which may result in you having to walk away from the contract.

                    Such is the nature of business, unfortunately.
