Jolyon Maugham QC, the barrister behind the case, is suggesting that this may lead to EU citizenship rights being applicable to every U.K. citizen born before the Brexit date, and not just those in continental Europe, so effectively he’s fighting to retain the rights of all U.K. citizens.

The case - if determined by the CJEU in our favour - could lead not only to the retention of EU citizenship for UK residents living in the EU. It could lead to all born before Brexit - even if living here in the UK - retaining the boon of EU citizenship.

It is.

Hypothetical situation, the CJEU rules that U.K. citizens born before Brexit remain EU citizens with all the rights that entails (incl FoM). The U.K. declines to provide those same rights to existing EU citizens, whether already here or not. I wonder how that will affect the negotiations from the EU side for the withdrawal agreement, the transition period, and any trade agreement negotiated afterwards?
