    Why I don't use an accountant....

    Two Montpelier users hit with £23,000 in tax fines :: Contractor UK

    Again, the taxpayers argued that it was reasonable for them to simply rely on statements from Montpelier about how transactions would be implemented under the scheme which, as ordinary taxpayers, they claimed they couldn’t carry out due diligence on.

    However pointing to the decision in the 2012 case Hanson Vs HMRC, the tribunal reminded that a taxpayer cannot simply leave everything to his or her agent, who in this case was Montpelier.

    This means the taxpayer is actually obliged to ensure that the agent has not made any errors and, the tribunal referred, “that might involve the taxpayer seeking to understand the basis upon which an entry on his return has been made by the agent.”
    I think too many people on here take their accounts advice as law, rather than what it is: advice. Ultimately you will always be responsible for yours and your LtdCo's tax affairs.

    PS for the lovely accountants on here who have helped me in the past, please don't think this as a bashing of your profession, its an indictment of the people who don't take the time to understand every aspect of their own business, or rely on others blindly.

    I think it's an exceptionally good thing to understand the advice you're being given, and to do your own sanity check on it. As you rightly say, it's the taxpayer that is responsible for the submissions to HMRC.

      Couldn't agree more - I think very few people who start contracting have much of an idea of the responsibilities that you will have when you run your own business

        Agreed it is your business and ultimately all the responsibilities rely with you the director/taxpayer so very important to understand it all.

            Absolutely right. I was at lunch on Monday with a guy who has been contracting since 2011 at a number of different places, fully accountant'ed up but he just doesn't understand anything.

            1. He isn't VAT registered despite being on a decent day rate and working 200+ days per year. His accountant "recommended" it but said it wasn't that necessary yet.
            2. He hasn't completed a self-assessment return yet. I really don't get it... He didn't think he had to because his accountant hadn't mentioned it.
            3. He hasn't reclaimed any expenses related to work. He didn't think it was allowable as he was going to his employer's workplace (oh dear)
            4. He hasn't PAYE registered and doesn't understand that there's ways to pay yourself outside of dividends. Oh, and he's never completed a dividend voucher.

            His accountant charges him about £700 p/y for an "accounting service" that he can't define beyond "well, I send him my invoices and bank statements each month and he tells me what tax I need to put away to pay Corp Tax. He sends me my annual accounts each year that I sign and send to someone."

            I suggested strongly that he go elsewhere and pay a hefty sum to start with to get his books in order and get some proper advice on how to fix things proactively before HMRC find out, put on the rubber gloves and don't use the lube jelly.

            I think that if you cannot understand your legal duties to the point that you absolutely trust everything your accountant says then you'd be better off going to a brolly if you insist on contracting. Maybe a little pop-quiz for new directors to see if they understand their legal duties!

            Just as in any profession, you have to wonder how some accountants managed to persuade their governing body to give them accreditation.

                  It can be fooking annoying when a reputable accountant firm ends up costing you money in personal tax though.
