Payment delay of more than three months

    Hello

I was contracting for 6 months with a company, through an recruitment agency. I finished there on the 4th of October. All time sheets were approved and sent at time.

3 months after the last day of the contract, I realized I haven't been paid the rate for the last 4 working days, so I contacted the payment solutions company, who say that the agency hasn't transferred them the funds.

That was one week ago, I haven't heard from them again. I don't know what to do, I feel as I'm helpless because they will just put me off indefinitely.

What would you do in my situation?

    Thanks a lot

What is a 'payment solutions company' ? If it is an umbrella then you will almost certainly have been an employee and they will have to pay you regardless.

If you were using a dodgy scheme provider then don't hold your breath.

Either way, what you do next is get on the phone them and hassle. It won't sort itself out.

Brolly girl is best for advice if its a brolly co.

Speak to the agency and ask them if they have transferred the funds, and if not, why not.

If they haven't received payment from the client, then they should chase that. At the same time, you should also check your opt in / out status to see whether you have any protection there.

By all means try to get it, but if you didn't notice for three months then it's not worth getting too upset over now!

            Thanks for your answers.

This opt in / out status, what is it about? I have been searching in the "Regulations" section on this page... is it related to the AWR?

            Thanks

You have rung one group once and now don't know what to do? Get a grip is what you need to do. Ring every bugger involved and keep ringing them until you get an answer. Someone has your money. Do you think it is acceptable to make one call and go to pieces? Sod that. Ring ring and ring again until they get so pissed off with you they either have no choice to either fix it to get rid of you or stop responding. If they stop responding you start writing and pointing out you will charge them interest and will start legal procedings. That will certainly get their interest. Be proactive, not just sit there doing nothing and getting upset.

Of course I'm upset after 3 months! I'm upset at paying an expensive management fee for an Umbrella company that does not have processes in place to control the payments have been done. It's their work to ensure that, not mine having to chase it. Obviously I will double check in my own benefit, but it's a lack of profesionalism on their side!

If I get your wife pregnant and you don't notice for 3 months, it's OK?

OK, so what does the umbrella company say? They are your employers, so that's who you need to be having the discussion with.
