IF a settlement were agreed .....

of for example 75% and you had CTDs that coverd 80% do we really believe they would refund the 5% - or would /could they just say ... tough - you had the money in CTDs so you can afford to pay so no settlement to lthat level for you ?

I check this forum only on occasion so as not to increase my blood pressure too much - upon checking it over the last week or so it appears we are doomed. Just wondering what happened to the seemingly high chance of winning or lease getting some sort of settlement?

You need to join NTRT. 75% is nothing to do with a settlement amount.

There will no doubt be HMRC meetings to discuss the responses to the pre-APN letters, wonder how the meetings will go if they say they havent had any responses!
When HMRC sent APNs to the film scheme investors they could be pretty confident most people would pay up without much fuss. After all we're talking multi-millionaires like Beckham. A few ex-footballers did complain about potential hardship but they were in a minority. 99% of the money was paid within the 90 days.

Now they are about to issue APNs to 2,000 ordinary joes. Many will be able to pay; many will not.

It's unusual to see a "soft" side of HMRC but they have no way of knowing how some people will react to APNs, hence the light touch.

            pre-APN letter

I may know the answer to this by the time I get home, but does the pre-APN letter show your liability?

No. It does not even give the scheme number. Just the years you are affected - and a warning you may be other letters for other schemes.

Interesting it says its an anti-avoidance scheme. Since when did avoidance become illegal?

mine gives both the scheme name and ref no

                its just above the years

I have sent an email to the addresses DR gave earlier. I want to reply to HMRC. They have requested to be told if we cannot pay. I don't see what is wrong with a letter saying I cannot pay. I think you have raised an excellent point - if they don't get a response they might assume we can pay.

I am going to discuss all this with my shrink. I intend to look after myself here. I shall take him along a draft letter I propose to send to HMRC - I wish I could post it here but I would be immediately banned and reported to the police.

not sure how one could be expected to know whether they could pay or not until the letter with the specific figure hits the door mat ....
