Very few of the members of the committee in 2008 are on the committee now.

You can see who was on it in 2008 here:
House of Commons General Committee a

All Tory and Libdem MPs voted for the Tories' amendment. All Labour MPs voted against.

Labour had a majority hence the amendment was defeated.

It's a bit of a nonsense that depending on which party you are in and depending on what you are told you vote that way. Like no-one made up their mind independently !

The difference this time is that MPs are making up their mind independently (cross party letter) and will hopefully vote accordingly.

I was speaking to a guy a while ago whose Labour MP was on the 2008 committee. He also happened to live on the same street as him.

Shortly after the debate he bumped into the MP and challenged him about the legislation. It was obvious the MP had no idea what he'd voted for.

PS. what also surprised the MP was that something like this had affected a family living in a modest house in an average steet.

Who did understand Section 58 in 2008

From a post in 2010, even the Chancellor of the time wasn't fully aware :

When confronted with the impact of S58, most Labour MPs are appalled. They don't even try to defend their Government for introducing it. Even Alistair Darling has said this shouldn't have happened.

You could accuse them of being two faced but I don't believe so.

If HMRC/Treasury are counting on Labour to support S58 they can forget it.

HMRC and Treasury civil servants understood Section 58!

Jane Kennedy* has since claimed she wasn't aware of the impact but I find that hard to believe given some of the statements she made at the time.

Yep, that was me. His quote was something along the lines of 'I didn't realise I was voting for that'. He's never been overly helpful in sorting it out though!

I got a 6 page reply from Gauke via him a while back. Whitehouse are preparing a specific reply (which I've chased them for now that the amendment has been tabled) then I'll go and meet him.

Anyway, thanks as always to DR, Whitehouse et al for keeping things rolling forward.

That applies to my MP too - some sympathy with our plight but "sorry I cannot be more help, as ministers seem to have made their minds up". I've just booked a follow-up surgery session for 7th June, by which time I'll hope to have had even more ammunition from Whitehouse and be able demonstrate to him that some of us have MPs who have been able to help !

David Gauke had to repay £26k that he'd avoided in Capital Gains Tax by flipping his main residence.

so is that the plan at the moment?

... book and see your local MP and give them the update (and try to influence the panel >?)

or is there some other plan that we should wait for ?

My mp Paul Burstow Lib Dep is busy trying to save the local hospital and had a little bit of sympathy last time and we did have our 15mins .. but never really threatened to be too commital !

                      cheers all
