No To Retro Tax – Campaign Against Section 58 Finance Act 2008

    Totally agree Emigre, in the last few months theres been a mass of information uncovered and an excellent strategy has formed. Theres a real difference in the results obtained through the passion and efforts of people directly affected rather than by the Tax lawyers etc that aren't. Ultimately that will make the difference in winning through, not chasing some remote chance of getting HMRC officials in trouble, sacked, chastised or otherwise. In fact I wouldn't be at all surprised if the individuals behind BN66 havent already had their career progression within HMRC completely halted but what do we care. Our focus is on obtaining evidence to prove the retrospective element of S58(4) was unjustified and should be reverted, closing Gaukes boltholes and forcing MPs to take notice. If that strategy fails then the evidence will be used in ECHR and tribunals. Compliants/Action against HMRC might come later but right now its just a waste of time detracting from the excellent strategy already in hand.

        Letter received from MP after meeting with Gauke

        Just received this from Mark Menzies, MP.

        "Thank you for coming to see me at my surgery last week.

        As we discussed I have spoken to the Minister about this matter. As I am sure you will understand we discussed the situation with Section 58(4) generally rather than your case specifically.

        Unfortunately he was not able to make any commitment to changing the position.

        He did say, however, that he is happy to receive further representations on the matter and, while I cannot promise any particular outcome, I am certainly happy to continue to assit you by passing them on and asking the Minister to reply. I would advise you, as I did at my surgery, to pass on to me any information that you feel may help to persuade the Minister to look again at the case. I will in turn send it on to him and make sure it is looked at.

        I am sorry I cannot be more helpful but, as I am sure you will understand, when matters end up in the courts it is often very difficult for MPs to have any influence over them.

        Thank you again for taking the time to come and see me and please do not hesitate to get in touch"


        I'm taking a very positive outlook on the content of the letter because it reads that Guake is willing to listen instead of the standard response crap. I'm also taking it that my MP is clearly being helpful.

        Now then - what next to bombard them with? I've already sent the usual suspects but will need some fresh amo.

          This is better news than recent Tory mp responses. I would wait for someone from No2retrotax or whiteHouse to make the most of Gauke's new stance.

            During a meeting last Tuesday lunchtime between Gauke and a bunch of Tory MP's (mine included), they were all instructed by Gauke to shut all of us whingers down as there was no intention of changing anything. As a result I got a response from my MP telling me to get over it and prepare to be reamed.

              Slowly, but surely we are chiselling a little hole in the wall of the dam.

              That wall is beginning to crack and we can see a little trickle of water. But keep hammering, because the dam that HMRC built is looking a bit shaky and at some point will not be able to contain the lies and deceit that are the foundations of Section 58.

                What happened is that the groundswell is starting to form, thanks to the excellent ongoing efforts of NTRT's Chairman and his crew, as well as Whitehouse's momentous recent progress, and of course all those CUK members and NTRT members who have realised the importance of fighting this matter and meeting their MPs ASAP to explain the facts of this matter.

                  Good stuff Lucozade. I think the fact he is now 'happy to receive further representations' is indeed progress. As White house have said, don't be discouraged by standard responses. Only tireless correspondence will overcome the 'Gaukalities'.

                  I have also been in touch with a fellow scheme member today. He was unaware of the campaign and this forum but, with renewed vigour, will now engage his MP. He knows of two others under the same HMRC hammer. One was an accountant promoting the scheme so must know several others involved. We will endeavour to contact them and confirm if they are putting pen to paper. There's may well many low 5 figure affectees out there that are sitting on the fence. Strength in numbers.
