    electronic timesheet processing.

    I'm contracting at the moment through HaysIT.

    HaysIT have told me that they will only accept original timesheets
    posted on Friday or Monday.
    They operate a fax service only on Thursdays and Fridays which
    is too late for payroll processing for that week.

    Effectively this means that unless I post my timesheet on Friday,
    I will not recieve pay for the next week.

    Is this legal??

    Oh FFS - a whole week waiting for your money. I never knew such hardship existed. If you don't like it, why did you sign up, may I ask? I know, let me guess - never read the contract.

    It is legal. If you don't like it, you can ask for a different arrangement - for example, direct invoicing - but you'll find the payment terms are even longer.

      Regulation 33 of the code of conduct for employment business's-

      Provides that throughout the regulations, unless otherwise stated, any requirement to notify a person of any matter, to give or send a document, to provide a persoin with inforamtion or make enquires and receive answers, can be discharged in writing either on paper or by electronic means.

        Hays run a batch job that processes at timesheets on a Wed/Thurs, with payment being sent out on the Fri. Provided they get the timesheet by that point, you get paid. I've never missed a payment yet

        All you need to do is get the timesheet signed by Friday lunctime and get it posted to them by the weekend. Job done

          Well found and quoted, but what has that got to do with anything?
          That section deals with notification like "we will be closed on Friday" or "We are going bankrupt" it has nothing to do with authorised time sheets. Each agent is entitled to its own rules and regs on this.

          As Mal said, it is probably in the contract terms so no complaints.
          I am not qualified to give the above advice!

            Errrrm let me think.......... Of course it is!!!!

            Get a life 7 days is nothing, Hays themselves probably have 90 day periods between raising their invoices and their large corporate clients paying them so they are hardly taking the p1ss.

            As mentioned by others you could always try direct invoicing but I'm willing to bet you'll be waiting at least 30 days for your cash this way.

            BTW If you were a permie you'd have to work longer than this in lieu before being paid so you can't grumble really

              Agreed that Hays have their own contract for this.
              My dispute is that the contract itself is unlawful.

              I have spoken with the DTI (without mentioning Hays
              as yet) and they agree that section 33 covers all
              transactions between employment business and employee,
              including timesheets.

              Hays have also been bundling my holiday pay with
              my hourly rate, which is a bit naughty too.

              edit. - you probably think I'm being real anal about this
              and you're right. But I'm new to this and still living
              hand-to-mouth. I have to get forwards through my
              umbrella and it messes up my taxes. it's cost me
              hundreds.

                To put this in perspective, 7 days is pretty good going considering a fair amount of agencies can and do take up to several weeks to pay and sometimes insist on monthly timesheets only.

                I know it's frustrating when faced with dodgy contractual things like this but companies such as myself that are dealing direct with large clients without the luxury of a factoring company often have to wait anything from 1 month to half a year before payment.

                And that's often on how well you've negotiated the milestones of the project.
