      Sempra case being heard tomorrow...

      Just found this...on

      http://www.metalbulletin.com/Article...nt-scheme.html

      23 February 2009 00:00

'RBS Sempra is preparing for a court battle over whether the London Metal Exchange ring dealer should be liable for corporation tax on a payment scheme to traders that began in the 1990s. The UK High Court Appeals will hear the case on March 10 and March 11, a court official said, as the controversy over bonuses for staff at RBS, which is now majority owned by the UK government, reaches new heights.'

I've just had a reply to my enquiry from Tenon: they are washing their hands of it. One of their tax directors wrote: "The beneficial tax scheme that ASMG Ltd/Marra Solutions take advantage
of is not something that we are connected with in any way and cannot
        therefore advise or help you."

Sal626, did you speak to anyone in particular at Tenon, or perhaps you can post the contents of the email you got from them (after editing anything personal to yourself)?

My next port of call should be Marra.

            Marra : http://www.marrasolutions.com

              And another month begins...

Well that's it for March. The Sempra Metals case on which so much depends was apparently heard in March. Does anyone know what happened in the course of the hearings and when we/anyone can expect a ruling?

And another thought: if Hector loses this, is it feasible that they will appeal? What laws are there to stop Hector from appealing again and again and dragging this on and on for years?

In the last update from DMS, they said not to expect a ruling until "summer". Also bear in mind, the appeal was related to Sempra, and doesn't have a "direct" bearing on ASMG - i.e. the way the schemes are set up are different. As to the number of appeals....I guess they can only appeal to a higher court...and after the highest court thats it. I don't think they (or anyone generally) and appeal a court's decision to the same court....

The highlighted company is called Assign Solutions. Are you sure it's the same one? I used this company and have also got the letter, but Assignment Solutions was an Isle of Man company, not a UK company.
