    Hi Lnz

    Since my last post, I have not had any further comms from ASMG. I will chase them up tomorrow I think.

    Have you heard anything or had any communication from ASMG by snail-mail or like me by a promised email?

    Have you spoken to anyone there and did you get anything different from what I posted in my previous entry?

      BTW Lnz, do you know anyone else who was/is with ASMG who may be interested in signing up with this forum. First of all, there is the issue of information sharing, then there is the mutual reassurance and support that comes with numbers.

      Finally if we gang up and keep knocking on ASMG's door we are more likely to get prompt action.

        when i spoke with them, i was told the same thing as you. they were familiar with the contents of the letter even before i had sent it over to them and stated that i simply need to refer any additional comms to them.

        they said it is very likely the only other letter i will receive on the matter will be in a few months time, confirming that the investigation is complete.

        i don't know anyone else who used ASMG. will be sure to mention this forum though if i find anyone.

          Hi Grim,

          I was with ASMG (DMS were the actual solution provider) from nov 05 to nov 07. I only left them because my next contract (starting jan 08), was actually with a recruitment company and they only used 4 umbrellas or your own limited co (in hindsight, should have gone for another contract). My returns for 05-06 was queried, and lately 06-07 has been queried. In both cases, I actually had an email from DMS, before I even received the letters from Hector, letting me know the enquiry is about to start. I also know about 3 other people on ASMG who got these letters. Basically it how others before have mentioned...because the scheme is registered, Hector is enquirying into it. I have not been asked to provide any info and ASMG is dealing with the whole matter.

          In fact, I have been impressed by DMS, as they are being very proactive, and I am getting regular email updates from DMS. If you are not getting this, contact DMS and they should add you to the distribution list. They say that they have provided all the info to Hector, and since then are waiting for futher queries etc from them, but have not heard anything. Last update I received was about receiving a enquiry letter about 06-07 (only because 05-06) is being queried. In that email, they also mention that once the jan 31st deadline has passed, they will chase Hector to conculde the query.

          I also emailed them just last week about BN66 issue. They replied saying that their scheme is not affected by that. So they are defnitely not part of what is going on with Montpiller, etc. Will update here if I hear anything new.....but I'm not too worried about this one.

          I'm more concerned about Steed who I am with now.....as they are also involved in the BN66 issue, but they said it was thier previous scheme not the current one I am on (only been on it for 3 weeks so far)....Anyone heard about or used sanzar/tax design....am researching them at the moment....may start a new thread on this.

            I got an update from DMS re:asmg today.

            Basically HMRC are appealing the decision of the Special Commissioners in the acse of "Sempra Metals" to the high court. The sempra case also involves EBT and loans. Anyone know anything about this?

            Apparently this is the second time HMRC have attempted this argument. they previoulsy did this in the Dextra case and lost. So ASMG are confident that HMRC argument will fail again, and all case law precedent is in our favour.

            Obvioulsy anything can happened....but looking good so far....

              The only Sempra Metals case that I can find was heard in the Lords in 2007 (HMRC lost), so that's the end of the road for that (it had nothing to do with loans).

              As to Dextra, IIRC it was the loss of that case that caused the statute on EBTs to be changed, so that case law is now dead and useless.

                  Hi, I'm back and many many thanks to SAL626 for the information. To date I have not had even a smidgen of contact from ASMG or DMS. In my sole chat with ASMG I was told I was on the contact list!

                  I am familiar with DMS because they did my first tax return via ASMG way back in 2006 I think it was. After that year, a different company was used by ASMG (Tenon, I think). The one Hector is querying refers to the Tenon created one.

                  Perhaps I should bypass ASMG and go straight to Tenon?

                  I did ring back just to confirm email address and was told it is monitored all the time. To date I have not had any replies and the ASMG website is still down. I'm not sure if speaking to ASMG is flogging a dead horse now, or if I'm just being paranoid or overreacting to the silence.

                    Yes, Tenon also did my 2nd return for this scheme. They are also involved in this and working with DMS (I've had an email from Tenon, via DMS). I'm suprised you havn't heard from them, best thing I recommend is to call them and ensure that THEY have your email....

                    ASMG scheme is now operated by another company - they let all contractors know that this was happening. I had actually left the scheme by then - only because my new contract with the agency only worked with 4 pre-approved umbrellas. But I know a couple of people who moved over to the new company....and they have had no problems - one of them has her SA for 2006 being queried and that is being handled by DMS.

                    So ASMG defnitely have not "disappeared". Dont worry about that.

                      Thanks for that Sal626. I think as the return in question was done by Tenon they should be my first port of call. Do you have a contact or department I can approach? I guess I could just dig up my paperwork and see....
