I assume that as you're so confident you've got the upper hand on HMRC you'll invite them to approve your scheme?

HMRC don't "approve" schemes. We just work within the law as it stands.

With full information I might be interested in the scheme, but without extensive details my instinctive reaction is to avoid like I would a plague bearing rat.

Whose law is that I wonder? Lichtenstein's? The Cayman Islands? Klingon? OK, I've got this perpetual motion machine over here: yours for £50 and you'll never have to pay an electricity bill again.

I just love the idea of selling a product that has the capacity to totally f*** up someone's life without having the balls to explain what it is, why it is legal, how it avoids the Dec 9th ruling or even roughly how it works. And I'm sorry, but I don't believe a forum name of "Swear to God" is sufficient guarantee either.

It's UK tax law. And I haven't tried to sell anything. We of course explain everything fully to anybody interested in signing up, and if they're not happy with the arrangement, they're free to not sign up as they wish. I'm not aware of anybody's life we've messed up either.

I'm interested in signing up. Explain it to me. Here, now, in a reply to this post.

Sorry, I'm not able to do that at the moment. We're currently moving over our exisitng contractors, and once that exercise has been completed I'd be happy to have somebody contact you to explain the new service.

                      QED...

You're not at liberty because your scheme depends on a QC's opinion on a point of law. Which may or may not be worthless, QC's are very good at telling what you want to hear, but it is your USP and you don't want anyone else getting wind of it. Fair enough.

But that opinion also represents a fairly major risk, given HMG's very wide-ranging attack on any kind of artificial avoidance. Which is why we treat your mysterious pronouncements and promises of hidden revelation as total hogwash rather than commercial confidentiality. After all, it's not you who has to pick up the pieces. Meanwhile we will continue to do all we can to dissuade the uninformed from joining your little party.
