If so, then HMRC may just be trying it on.
It would cost you nothing to appeal, and the grounds would simply be that the loan was not income. This will put the ball back in HMRC's court and test if there is any substance behind their rhetoric.Comment

GAAR 2013 Legislation
Looks to me its end game to all forms of tax planning concerning numerous marketed schemes.

Appears many in business are bemoaning it will create uncertainty and confusion. Well imo thats exactly what HMRC wanted from this.
