    Divorced from the UK

    So what about someone who got divorced and his ex got the 2 kids, 5 & 7 years old. He's told to pay maintenance and provide a house for them as he's the one with all the lolly?

    He then moves abroad and comes back every year to visit his kids but has otherwise set up a new life in Antigua with a "local lass".

    I guess the same rules apply to him even though it was not his choice to keep some ties with the UK, but the courts. Or will he be exempt as his is a different interpretation of IR20?

    Mad, all mad. The economy os going to hell in a handcart closely followed by the written law. I do hope there is someone in authority that sees the folly in all of this.

      Its truely amazing isnt it? I had an 'exchange' with someone posting as AtW in the General forum.

      Obviously a troll of sorts. His tax affairs are squeaky clean. If I read his diatribe correctly, he instructs his accountant not to tax up tax advantages as he doesnt want any hassle from HMRC.

      It hasnt dawned on him yet that with retrospective changes etc, even his current legal within the law definition tax affairs may be changed retrospectively in the future.

      Oh and he thinks we're a bunch of 'cheats' and 'pisstakers.'

        For more than 34 years he does not spend more than 91 days in the country....and loses in the Court of Appeal, three judges. Again Letter of the Law vs interpretation, that does not bode well for our case.
        Makes you wonder about the detail. The devil seems to be in the detail. I am Australian and left there in the 90's. When I left I had to write to the Australian Tax Office and tell them I was no longer resident and change my Australian bank account so that it gave me no interest. I thought that a little extreme but can understand it. This guy seems to have been living in both countries despite the 91 day rule. That said a rule is a rule and the revenue shouldn't punish him for following their guidance. It is retrospection again.

        I am thinking that I should move back to Oz (and make sure I don't have any ties you know like shoot the dog and the mother in law just to be sure).

        The tax advice consultation is just insane. Where oh where is this country heading to. Nu Labour are ruining what is left of this country.

          Correct. It's just that - guidance. It does state quite clearly it does not have force of law. The same is strictly true if you ask them for an opinion tailored to your circumstances. The same is true of the VAT man and lots of other bodies.

          Personally I wouldn't really want it any other way. If their guidance becomes binding then there is implicitly no right of appeal. In this case the administering departments would actually be making the law.

            The site seems a little reactionary, but the facts remain. The tax manual
            has grown out of all proportion under Gordon Brown's stewardship, probably
            to the point where it requires specialist advice to deal with taxation matters.

            Now, they don't like it when the swiss cheese is exposed.

                    When I think about this, I've known a few people who have gone to work in the Middle East, with wife and kids back home, and stuck to the 91 days or less rule. These aren't rich people, by any stretch of the imagination, just engineers etc. They must be caught by this as well. There may be lot more than a few multi-millionaires hacked off with this.

                      I am too young to remember, but was it like this when the last Labour goverment was coming to an end? Were they this bad?

                      I remember a friend of the family who was staunch Conservative, and used to say Labour were the worst thing ever for the country, I could never understand why he was so against them. Now I understand.
