An HMRC Technical bod(ess) has just returned my phone call.
In their 'opinion', a one man band ltd co with one director as an employee and NO other employees would be
stretching it a little claiming for a party expense ...on your own!
I posed this question to her:
If I am a contractor with my own company (which I was) decided to go out with some other fellow contractors for a 'Christmas lunch', could I claim the cost?
She replied:
Yes, I could claim it as subsistence
I decided not to question further regarding a Christmas lunch being classed as entertainment!

Surely if it's subsistence you can only claim it whilst away from home.
So going out with some local contractor mates would be disallowed?

That's what I thought. You could claim it as "meeting expenses" if the receipt is vague enough - as part of hiring the table to have the meeting at, they provided food and drinks

Myself and I am sure many others are watching this thread with great interest to see if an answer can be found and if we can partake in a bit of xmas cheer with a pat on the back from HMRC but...

strikes me as being a bit tight.. I think someone else said, is it really worth claiming this an expense and maybe falling foul.
Maybe it's the wording that makes it seem like a trivial night out compared to big xmas pissup so my apologies if it is.

Frankly for the sake of £31.50 CT saved for every £150 ...NO it's not, you know how HMRC like to go from a simple enquiry to a full blown IR35 enquiry.

Is this really going to be a tipping point though ?
