Some clients of S-M have even told me that they were completely unaware that S-M was a separate scheme to MTM. The Directors of S-M covered up the split and led these people to think they still had the backing of MTM.

We can't prove for certain that S-M passed our details to HMRC, but if they did wouldn't this be in breach of the Data Protection Act? I for one certainly didn't give them permission.

Wouldn't HMRC also be complicit in such a breach of DPA?
Forget the cold-calling...the Director of SuoMuto walked up to me in a half-empty bar on the IoM in full view of the TOP MAN of MTM, gave me his contact details and told me to call him about his SuoMuto scheme...TOP MAN of MTM who was spitting nails at the time called the police (for reasons that we later came to understand)...

Jones, if you are reading this, do you remember me?...cos even after nearly 9 years I havent forgotten you...

Suo Motu settlement may be the best deal since sliced bread if Montpelier lose the JR.

And after all the facts come to light you may be accusing someone else of leaving you "up the creek without a paddle".
        Hello again Mr/s Amnesia,

'IF Montpeilier lose the JR' Are you losing faith in your undoubted

There are plenty of threads that discuss these people. My apologies if you have identified a direct relationship between them and our issues. If you have please share it.

                Emigre

I am affected by BN66 and currently work through MTM and keenly await the JR on 190110 to see whether my life will be ruined...or not

I stumbled across Darwin as an ad in our local paper in Aberdeen, I dont work through them but just wondered if anyone knew anything about their scheme as they claim 88% net return and no chance of HMRC investigation.....!!

Apologies. No offence meant, keen to stay focused on the big day when HMRC finally understand that their behaviour is less enamouring than that of some of the world's despots and dictators. Perhaps we can get Tony Bliar in for a regime change?

In your original grounds for opposing the application, you stated:

"HMRC had made both the general public and professional market well aware of its view in 1987 that “partner” and “member of a firm” included any person entitled to a share of the profits of a partnership. HMRC say that this obviously includes a life tenant of a trust where the trustee is a partner."

I now put it to you that you deliberately and wilfully misled the Court in an attempt to prevent these proceedings from going ahead.

                    How do you respond?
Haha.. more chance of Jones turning up to give evidence at the JR than HMRC responding to this

Let's be very clear on this. At no time between the first 'You are under investigation' letter I received in 2003 and the announcement of BN66 in 2008 did HMRC ever mention the above view to me. In fact I received a letter from them in 2004 quoting some tripe about another case (Archer v Baker-Shee or something) which HMRC reckoned invalidated our claim. One letter from MTM saw that one left dead in the water. After that..... zilch about any other legal stuff.

This apparently is what HMRC regard as 'consistently making the case the scheme didn't work' to quote Jane Kennedy.

                    Yeah, right.

Ah amo, that old chestnut 'better to be quiet and be thought a fool than speaking out and removing all doubt...'

see you on court; I'll be one of the many smarmy smiles on hearing justice and common sense prevail
