    it's just such b*llsh*t that with 3 months (its not as if the legislation was a surprise by the way) MP coudln't get the required letter/application in on time. why even risk it being on the day or near the deadline date it's just incompetent and doesn't fill me with confidence. Luckily there are anoher 3 JR applications by the sounds of things, maybe SOMEONE out there is professional and competent enough to get HMRC by the balls.

      It was the PWC QC that mentioed this to the LJ.
      It was news to me and to be honest the judge wasn't very happy about it as there could be inconsistent decisions or judgements.

          Chaps, as people have being saying... I don't think the MP delay will be a problem.

          Did anyone categorically confirm if the LJ can push this aside in the decision process?

              Not worth getting too excited about the 1 day late issue without knowing the full story. I expect we will have a better day in court on June 16th.

              Perhaps HMRC will be less prepared if they think it will be this easy !

                Well life throws us the odd curve ball at times. I also have a very large "lot" to lose on the outcome of this process. But, I try and keep cool and until we know all the facts then I shall remain open minded.

                As stated, there are other avenues of process open to us. I seem to recall that one party is bypassing JR altogether and heading off to Europe etc.

                This will be a long process. I've been locked in a Film Partnership dispute for the last 6 years.

                  You are not suggesting that HMRC are arrogant are you?

                  I hope they do go in with the "1 day late" defence because I can't see the Judge being one bit impressed with that.

                    An anal judge might, after all is this not the rule? Unless it has been allowed in the past? Otherwise you have 3 months and 1 day to get applications in!

                    I hope that this is a small point that will be overlooked but it is causing a lot of unnecessary stress that we could do without.

                      From the horse's mouth (WG).

                      Our application was NOT late.

                      It was submitted within the 3-month window.

                      Given that this "info" eminated from HMRC yesterday, we should disregard it as FUD.
