In the worst case scenario (i.e. we lose) and I have to somehow find
the money, does anyone know if I can use my pension fund to help
pay it, it would probably pay about 2 thirds, but I'm not sure what the rules are.
The only way I know of that you can withdraw money from a pension is if you are over minimum retirement age, currently 50, in which case you can take a 25% tax free lump sum. From April 2010, minimum retirement age rises to 55.

I doubt whether the courts can treat a pension fund as part of your assets when it comes to debt recovery. I would expect they could only take it into account once you started drawing a pension.

However, I'm not an expert so it would be worth getting professional advice. Try contacting your pension provider, as I'm sure this must have come up before.

Don't think this is an option, I tried this a few years ago and was told no way can you access it even to cover debts that could bankrupt you.

Some Company pensions allow you to borrow funds out, you may be able to do that? Not sure on the current rules but worth asking your pension provider.

Ah right! maybe mine have gone direct to MontP then. I think a quick e-mail would not be too much of an effort. I am sure there a few but can't imagine too many who are still oblivious to this and should be made aware.

I haven't had any CN's yet either, but when I contacted Montp about this they said that the CN's were being sent out from local tax offices, therefore they had no idea when the tax offices would get round to it. How would I find out if Montp are classified as my Advisors to know whether the CN's would be sent to me or Montp?

I did speak to TQ yesterday about working out how much hector thinks I owe as I'm thinking about getting some CTD's, but don't know what my exact figures are. He said he's working them out for me, so I assume they haven't had any CN's yet on my behalf, but it would be good to know whether I will get them at all. Anyone with any ideas?
          Thanks!

The CNs will always be sent to you, regardless of whether you have got an agent or not. If you have an agent, then they will also receive a copy.

The thing you've got to watch out for is if you have moved house. Have HMRC got your correct address?

You can check both these things if you register on the Govt gateway.

Check out the first page of this thread for this and other related info.

Thanks DR. Yes, they have my correct address as all the 'Inquiries' into my SA returns come to the correct address.

I'll have a bash at the Govt. gateway and see what's on there.

                Thanks MP

NW and folks got my recent troubles sorted. It seems my postponement application was 'overlooked' by HMRC. Hmmm, funny, yesterday they were refusing calls from MP, today they have a note saying that I had given authorisation to Montpelier. Funny that, I never mentioned Montpelier's name. Just reappeared. Magic, perhaps.

Another amusing moment, when one of the Local Compliance Officers asked if I was aware there was a 6 figure sum outstanding against my account. Umm, let me think ... yes I do remember something about that when I put my mind to it. I nearly 'overlooked' it.

                Thanks to NW and team.

                  Please sign the petition

                  http://petitions.number10.gov.uk/RepealSection58

I have not signed it yet otherwise the enemy will know who I am but I will be doing. We need to get a few signatures initially so that others will pluck up the courage to sign it.

Once the ball is rolling, I will be rallying support from anyone I can.

By the way, it's best not to post here that you have signed it just to be on the safe side.

Out of curiosity - how long after signing up and confirming - does it take for a name to be added?

p.s. It should be "thousands of families" not "hundreds"......... can it be edited?

surely they know who we are already? I dont see why they would object to anyone signing a petition, and wouldnt they expect us to?

having said that, might wait a bit
