    That is different. It would win them a lot of votes.

    Also, I bet it can be shown that IR35 has failed. Most people have just carried on drawing dividends as if it never happened. And it has spawned a proliferation of tax avoidance schemes which net the Exchequer zilch. The only real winners have been the tax avoidance promoters.

      I have been watching this thread on behalf of one of my SA clients who appointed me his accountant when he left one of the schemes mentioned on this thread. So it has now become my responsibility to deal with this on his behalf.

      I cannot say too much, but from consulting with other specialist tax advisers we are horrified and shocked at the retrospective nature of this...........

      The House of Lords are currently changing some of their rules and stated that it would be wrong to apply it retrospectively.

      It is unfortunate you were not Bankers, MP's or members of the House of Lords.

        IN 2001 they promised to repeal IR35 if they won the next election. I have this in writing somewhere if I recall correctly from David Heathcoat-Amory.

        Subsequent to this (and they didn't win the relevant election) it's gone a bit quiet. Though sometime in 2007 John Redwood was advocating ity's repeal. I don't think it is currently a manifesto commitment.

        Can't currently get to the tory website to see what it currently says, though I'm pretty sure it had disappeared at the last election.

            In my letter to Ed, i actually stated that the only reason im on the scheme was because of a 2 year waste of time IR35 audit.....

                I want to get a feel for how many people on a higher rate (>£50k) are operating inside IR35.

                The results may be a bit skewed because it's probably mostly people trying to get around IR35 who visit this site. But nevertheless it will give a feel for whether net tax receipts have benefitted much from IR35. My suspicion is NOT but we shall see.

                    Interesting post. Do you know if they're applying their new found rule on restrospective legislation, retrospectively? I wonder if someone in the HoL is on the receiving end
