    I dont care if we get it or not. UK judges will be bribed : happened once will happen again. In Europe it will be a different matter.

      Don't read too much into the refusal of the written application. This is a normal occurrence. It is part of the process that the Courts use to screen applications.

      Montpelier should have explained this in the Circular.

      The oral hearing will be held in front of a different judge.

            PriceWaterhouseCoopers

            Filed an application with the ECHR last November. They used Brannigan's newsletter as a basis for the application (the bit where he said that the only remedy available in the UK courts was a declaration of incompatibility).

            They are putting together a class action for property developers. One of their clients has put £60M through the scheme.

            Their budget for legal costs is £1M, and they reckon it will take 3 years.

              thats great news if we can fend off collection for 3 years. we'll be half way thru david Cameron's first term. in 3 years I might be able to save quite a bit (if I'm working of course)

              what do you think DR.. can a forthcoming ECHR case be used to prolong our appeals?

                Don't know. Steed Solutions have also applied to ECHR, so it's not just property developers.

                Our puny JR is starting to look like a bit of a sideshow.

                  Can we get any commitment from conservatives to drop the changes if they get voted in next year?

                  I for one would go out an campaign for them...and I would guess that a few hundred other people would too.

                    They are not even prepared to make tax & spending commitments on bigger issues, so sadly we've got no chance.

                    The only hope we might have, once they are in power, is to persuade them to get HMRC to drop the legal battle on the grounds that it is a waste of public money.

                    By writing to MPs now, and drawing attention to the fact that many people don't have the means to pay, we are planting the seed.

                      I remember way back they offered to drop IR35 if they got in power....Anybody know if thye still intend to do this?

                      After all, ir35 is the reason why we are all in this bloody mess. (thanks again labour)
