        Reports this morning are stating there is growing frustration within government at the Civil Service 'withdrawal' from Labour co-operation, in anticipation of a likely Conservative government next year.

        Latest IPSOS/MORI poll puts the Tories 20 points ahead.

        Conservative lead rises to 20 points over Labour
        Fieldwork: 13-15 Feb 2009
        CON 48%(+4) LAB 28%(-2) LIB DEM 17%(n/c)


        The longer they cling to office the more the unpopularity with Nu-labour will turn to hatred, which will hopefully see them out of office for a generation.

        So HMRC isnt it time you considered your actions with regard to BN66, and the possible fall-out that will follow a change of government. You have no moral authority to pursue it, and I am sure deep down you know it.

                This is yet another reason why writing to MPs now is important.

                I have heard from a senior QC that Section 58 is a discretionary tax. There is no compulsion on HMRC to actually collect it.

                In other words, it is not necessary for a future Government to repeal the legislation for this to go away. All they need to do is tell HMRC to drop it.

                So please keep writing.

                      The collection of it is at HMRC's discretion.

                      The Act gives HMRC the means to collect it but unlike prospective legislation, it doesn't require them to do so.

                      At least this is what Giles Goodfellow QC reckons anyway.
