    I was not using the scheme for 07-08 (currently have my own Ltd). Was however using the scheme for 02 > 06, have received all my CNs (on Christmas eve !!!) and MP have appealed them all. I have just done my tax return online and at present can't see any sign of the appeals (although it does say that I currently owe nothing on the summary page which I guess is a good sign). However, if I view my statement (PDF doc) - I can see the amounts that I have appealed? Can anyone else see an acknowledgement of appeal, if so where abouts on the HMRC site?

      Mine arrived around Christmas and until a few days ago the amounts were all showing as outstanding but logging in today they have added an "amount suspended" to each year's statement cancelling out the closure notice demands. I'd suggest you wait a few days to see them process the appeals.

        surely HMRC couldnt take the risk of possibly bankrupting many people, only for their actions to be proved illegal possibly a year or two down the line ??

        Indeed, and what if the Tories repealed it in 18 months, to repeal retrospective legislation would of necessity have to be retrospective. Time is running out for the crooks at HMRC. Stop the insanity - NOW

          JR turned down !!!!!

          Hi All

          Woke up this morning to MP's update saying that the JR has been refused.

          MP are resubbmitting as they say the reasons for refusal are flawed.

          So it seems round 1 to HMRC

          Also in there are some bits about the appeals of the tax return is a seperate process and they dont expect any to be heard until Q4

            Just had the letter from MP saying that JR has been refused.

            Must admit I didn't see that one coming. Re-submission for JR in progress

              Also got the newsletter from Montp.

              Interesting times. 2nd stage is an appeal for the JR refusal which has to be given orally by the Montp Law team.

                Bit of a blow this morning with JR being refused. I think, like most of is,if we are honest, did not expect that!

                This is definitely a worrying signal, that at this early stage, the courts are not even willing to entertain the debate.

                Some interesting comments regarding discrimination which DR alluded to in one his early posts; on the face of it I would see this as equally damning and suprised this is not being pursued as an equally disturbing illegality.

                Not sure where this leaves us with appeal process....

                But I think I can comfortable say, Newsletter #2 cannot be written fast enought by you know who ......dogs at the letter boxes if you please.

                    According to the newsletter, it sounds like HMRC are dragging their heels over supplying details of the concessions they've made to some users of the scheme.

                    I wonder why?

                    When it comes out that they have let some people gain a tax advantage by using the scheme they ain't going to look so clever.

                    "We have always maintained that the the scheme did not work. It was clearly covered by the 1987 legislation, so it was unlawful. Blah blah blah."

                    So why did they do deals with some people?

                    Doh!!!

                      No received just the one today. Very much a blow to our cause.

                      I can see HMRC now becoming very aggressive using the window between now and an appeal.

                      Anyone have any thoughts if the appeal is also refused? Also how would this impact the group who have gone directly to ECHR?
