I mean who in their right mind could possibly worry about the anti terrorism legislation for example. Any suggestions that this big brother power might be abused are of course nonsense and scare mongering.

It's all perfectly reasonable - to any right thinking person.

Of course the fact that pretty much the only users of said legislation are local authorities to check on people is just a minor quirk.
And not forgetting the famous quote rolled out by New Liebour voting sheep every so often:

Yeah, right. Pull the other one.

Anyone read todays papers re dads who don't pay kids maintenance. The Gov now want to be able to withdraw driving licences and passports without even taking you to court.

To be honest, that's true. But the question - as you realise - is much deeper than that. Perhaps it should be something like "If you've got nothing to hide do you mind putting everything you do do out to public scrutiny?".

          Late Christmas Pressy

I received my late Christmas Present today from my local tax office, they were enquiring on 2006/7, the letter states my tax has been amended. It does not say the words closure notice anywhere. Have forwarded onto MP. Mr B was investigating 2005/6 but heard nothing from him yet.

The letter is really poor, it does not state any breakdown of how they have come to that figure, they enclosed an extra copy for MP by mistake the letter stated they were sending it direct, they forgot to include the appeal form and does not state any reason why the partnership income is now taxable. Have sent copy to MP to appeal.

The real shocking news was the "your total outstanding balance is now a very large figure". This was a surprise because I logged into SA 2 weeks ago and there was nothing owing. There is even a figure and interest for 2007/8 which tax return has not even been submitted (hurry up MP getting concerned here), how can these figures just appear? Does this mean I now have two additional closure notice/amendments on the way, probably from Mr B.

Now wondering what to do prepare whether to get a CTD for the large figure or sit and wait, problem is don't have all the money.

Thanks for all the posts, I really appreciate the recent ones why Padmore and the 1987 act does not apply to MP.

            From the Human Rights Act:

            Article 8: Right to privacy

            (1) Everyone has the right for his private and family life, his home and his correspondence.

            (2) There shall be no interference by a public authority with the exercise of this right except such as is in accordance with the law and is necessary in a democratic society in the interests of national security, public safety or the economic well-being of the country, for the prevention of disorder or crime, for the protection of health or morals, or for the protection of the rights and freedoms of others.

With regard to the 07/08 figures - they are the payments on account which have been generated following the amendments to 06/07, they are automatically generated and while some districts have reduced them down in accordance with the fact that they have had appeals... some havent bothered.

                    Interesting...

Got my tax return through yesterday - obviously working overtime at MP! - and found the statement on the overflow page interesting. HMRC will see this on the returns anyway so I don't think discussion here will jeopardise anything - but it seems that MP are arguing that S.58 doesn't actually apply to us anyway?

                    The amendment reads:

...For the purposes of subsections (2) and (3) the members of a
partnership include any person entitled to a share of capital gains of the
                    partnership.
Without going into too much detail on an open forum, MP it would seem do not think that we fall into this category. This appears to be an entirely new avenue of attack - that even the new legislation doesn't apply. I certainly am not qualified to comment on whether this is a realistic line to take - but at the very least it's nice to know that there are other possibilities beyond the JR!

Montp are up to their eyeballs trying to get all the Tax Returns sorted. They are still making sure CN's are dealt with but if people could keep non urgent calls/emails to a minimum it would be sooooo appreciated.

Thanks in advance for your co-operation
