      Received a SA statement with suspended amounts except the bottom figure was not zero within the same week received a distraint notice which was again sorted by NW.

          The Finance Bill has now been enacted and the clauses are numbered differently in the Finance Act. I wonder if you are referring to Clause 59 of the Act which relates to "UK residents and foreign enterprises"? However, this part of the Act only applies to income arising on or after 12th March, 2008. Perhaps you can explain your problem in more detail but I have to say that I cannot intervene in court cases.

            Tell him you are referring to clause 55 also known as BN66 which is a retrospective change to an existing law from 1987.

            Make it clear to him that your income will be retrospectively taxed all the way back to 2001 when you first started using the scheme.

            Also you could mention that retrospective taxation is an unprecented move, never before seen in the UK and uncertainty of one's future tax position is against Human Rights Law and bad for business in the UK.

              De-Lurking

              Hi, been lurking for several months after being pointed here by another Montp'er (one who's known to BP).
              Was with them 04-08 so significant exposure.
              Can pay some, but certainly not all.

              Not planning on getting a CTD.

              Always thought the scheme would be limited in terms of how long before it was closed down, never thought retrospective taxation would be an issue.
              This was also the view of a chartered accountant who deals with lots of tax returns, and ex HMRC employee within my family.

              Thanks for the useful info on this forum, keep up the good work.
              It's certainly helped keep me intent on fighting.

                  Same here. CN received 24th October and surcharge received 7th November. I also note it is two 5% surcharges not just one!

                      De-Lurking, well...sort of

                      Although not on the MontP scheme, I do follow this thread quite regularly. Obviously, the result of the JR will have a very direct impact on the tax planning world. Haven't had a lot to contribute so I suppose I have been lurking and just wanted to take the opportunity to wish all the best of luck with this.

                      Looking forward to seeing the whole BN66 fiasco thoroughly squashed!!
